越南丁陈时期“佛教—法律文化”研究

【摘要】:公元10至14世纪的越南处于自主封建时期,前后经历了丁朝、前黎、李朝和陈朝(简称:丁陈时期)。这一时期的越南既是汉字文化圈和中华法系的一员,又是东南亚佛教文化圈中的一份子。以至于它的法律文化既受到儒家思想的渗透又承袭了唐宋的法律文化和制度,还受到佛教文化的影响产生了颇具特色的“佛教——法律文化”。 公元968年丁部领建立“大瞿越国”标志着越南走向独立,到李朝时中央集权制的封建国家体系已初步完成,法律文化和制度日渐充实起来。与此同时,源于印度的佛教传入越南后随即得到了很大的推广,毗尼多流支派、草堂派、无言通派相继传入越南并扎下了根并诞生了越南本土第一禅宗——竹林禅派。越南禅师在汲取佛教思想的过程中不断地对其教义进行改造,衍生出了颇具特色的理论。有些禅师还参政议政对越南法律文化产生了很大的影响,许多制度可以说是在僧侣阶层的推动下制定的。 虔诚礼佛不仅风行于越南民间,也风行于统治阶层。丁朝至陈朝的历任国王也都以佛为重,奉佛尤谨以至于“百姓大半为僧,国内到处皆寺”。这些君王的治国理念也受到了佛教思想的影响,于是在这个背景下形成了独特的“佛教——法律文化”,其表现形式如僧官制度、试三教、寺院经济、王权佛授等等。这些法律文化是越南法律制度史中不容忽视的一部分,能让我们更清晰地还原越南古代法律文化的全貌。 借助于了解越南丁至陈朝时期“佛教——法律文化”之形成、发展、变化背后的原因,我们可以清楚地看到越南丁朝至陈朝时期不仅仅是一段法律文化的发展史,其实也是一段儒家思想的成长史,更是一段佛教的思想兴替史,这一兴替史的痕迹又反过来反映在了法律文化上。 同时,通过比较丁陈时期与陈朝之后诸朝以及大理国和蒲甘王朝“佛教——法律文化”之异同点,可以进一步了解丁陈时期的“佛教——法律文化”在越南法律文化史长河中所占的历史地位。也进一步凸显了兼具东南亚佛教文化圈、汉字文化圈及中华法系的丁陈时期“佛教——法律文化”所表现出的独特性、多元性及复杂性。
[Abstract]:From 10 to fourteenth Century in Vietnam independent feudal period, and after Ding Chao, Li Li and Chen Dynasty before, (referred to as: Chen Ding period). A member of Vietnam is Chinese characters cultural circle in this period and the Chinese legal system, and as a member of the Buddhist cultural circle in Southeast Asia. So its legal culture not only by the infiltration of Confucianism and inherited the Tang legal culture and system, is also influenced by the Buddhist culture has a distinctive "Buddhist legal culture".
In 968 part the establishment of "Qu Yue" marks the Vietnamese independence, to the feudal system of Li Zhaoshi centralized system has been initially completed, legal and cultural system gradually enriched. At the same time, the introduction of Buddhism from India to Vietnam immediately got great promotion, Lumbini multi stream of cottage pie. No words were introduced to Vietnam and sent through the root and the birth of the first native Vietnamese Zen -- bamboo Zen. Vietnam Buddhism in Jackson learn ceaselessly in the process of the doctrine of transformation, derived from the characteristic theory. Some Zen master in politics has a great impact on the Vietnamese legal culture. Many systems can be said to be made in promoting the priestly class under.
Not only popular in Vietnam folk religious ceremony, also popular in the ruling class. As king Ding Dynasty to Chen Dynasty have Buddha, in Foyou so that "half the people for the monks, domestic everywhere temple." these kings ruling idea was also influenced by Buddhism, thus forming a unique "Buddhism -- legal culture" in this context, the form such as monk official system, the test, the temple economy, and so on. These laws granted kingship Buddha culture is a part of legal system can not be ignored in the history of Vietnam, can make us more clearly to restore the ancient legal culture of Vietnam's picture.
With the help of Vietnam to understand Chen dynasties Ding "Buddhism -- legal culture" of the formation, development, the reasons behind the change, we can see clearly the Vietnamese Ding Dynasty to Chen Dynasty is not only a period of history of the development of legal culture, is actually a Confucian history, is a Buddhist thought the rise and fall of history, the history of the rise and fall of the traces in turn reflected in the legal culture.
At the same time, by comparing the period of Ding Chen and Chen dynasties in Dali, China and Bagan Dynasty Buddhism -- comparison of legal culture ", we can further understand Ding Chen's" Buddhism -- legal culture "for legal culture in the history of Vietnam history history. Also further highlights the unique Buddhist cultural circle with Southeast Asia." Buddhism -- legal culture "shows Chinese characters cultural circle of Chinese legal system and the Ding Chen period, diversity and complexity.
