论“山寨现象”及其法治意义

【摘要】： “山寨”一词或者说“山寨现象”是2008年的热门话题。如何看待“山寨现象”,大家众说纷纭、莫衷一是。但是总体上可以分为两种态度,一种态度为赞成、支持态度,另一种态度则是持否定的观点。这两类观点虽然针锋相对,但是,在我看来,恰恰是由于其二者着眼点不同,才导致了上述分歧。然本文的目的不在于寻求调和二者之方法,而是在明确区分两类不同种类的“山寨现象”的基础上,主要探讨那一类具有正面的、积极的作用的“山寨现象”。作为一种流行于网络上的社会现象,“山寨现象”的盛行,不得不引起我们法律学生的思考。目前,我国对“山寨现象”的研究多是从知识产权角度进行考察的,而我在本文则主要是通过对两类“山寨现象”的区分,集中讨论那一类不涉及知识产权侵权的“山寨现象”所具有的进步意义、法治意义,结合法治的三个方面:法律权利、人权和社会权力,探讨“山寨现象”自身所蕴含的积极因素,并且希望通过对“山寨现象”这一特定历史背景下的社会现象的分析,对我们发展现代法治、市场经济而带来的负面影响作出积极回应。
[Abstract]:The term "Shanzhai" or "Shanzhai phenomenon" was a hot topic in 2008. There are different opinions on how to treat the "shanzhai phenomenon", but generally speaking, there are two kinds of attitudes. One attitude is for approval, the other is for support, and the other is for negative views. These two views, though tit-for-tat, seem to me precisely because of their different points of view. However, the purpose of this paper is not to find a way to reconcile the two, but on the basis of clearly distinguishing two different types of "shanzhai phenomenon", this paper mainly discusses which kind of "shanzhai" has a positive effect. As a popular social phenomenon on the Internet, the prevalence of the "shanzhai phenomenon" has to arouse the thinking of our law students. The study of "Shanzhai phenomenon" in our country is mostly from the angle of intellectual property rights, and my main purpose in this paper is to distinguish the two kinds of "shanzhai phenomenon". Focus on the kind of intellectual property rights infringement of the "Shanzhai phenomenon" has the progressive significance, the significance of the rule of law, combined with the rule of law in three aspects: legal rights, human rights and social rights. This paper probes into the positive factors contained in the "Shanzhai phenomenon" itself, and hopes to develop the modern rule of law through the analysis of the social phenomenon under the specific historical background of the "shanzhai phenomenon". Market economy and the negative impact of the positive response.
