借鉴美国经验对我国农业职业教育法的法律内容之探索

【摘要】: 党中央曾多次提出,要大力发展职业教育。我国是一个农业大国,那么相应的,以农村广大农民为对象的农业职业教育就显得格外的重要。随着社会经济的不断发展,农村广大农民群众对农业职业教育的需求不断增长,我国的《农业法》和《职业教育法》越来越凸显出其在农业职业教育方面内容的欠缺。因此,为规范我国农业职业教育的发展,应当单独制订一部《农业职业教育法》。美国的两部经典职业教育法——《莫雷尔法》和《史密斯-休斯法》,能够对制订我国的农业职业教育法提供重要的经验借鉴。为了更加完善和规范我国的农业职业教育,借鉴美国的立法经验,制订一部我国的农业职业教育法,并对该法律的主要内容进行探索,将会是不无裨益的。 在职业教育立法方面,美欧发达国家有诸多经验可供我们借鉴。一直以来,研究美国两部主要针对农业的经典职业教育法——《莫雷尔法》和《史密斯-休斯法》的学者不在少数。与此同时,诸多学者也对我国农业职业教育的现状进行了大量的研究工作。近年来,我国农业职业教育事业取得了一定的成绩,但尽管如此,仍然存在着一些不容忽视的问题。目前,我国并没有制订一部名为《农业职业教育法》的法律,然而,我国农业职业教育事业的现实状况却在呼唤着一部调整和规范农业职业教育事业发展的法律的出台。只有制订出我国的农业职业教育法,才能够更好的体现农业职业教育的重要性,也才能够从根本上解决我国农业职业教育方面存在着的诸多的问题。我国这部农业职业教育法的制订,应当以《宪法》、《农业法》、《教育法》和《职业教育法》作为依据。 《莫雷尔法》和《史密斯-休斯法》是在美国职业教育发展进程中具有重大历史意义的两部经典法律。这两部法律通过各类具体、详尽、可行的措施,奠定了美国职业教育和农业职业教育的坚实基础,切实保障了它们稳步向前发展。这两部经典职业教育法丰富的立法经验,可以为我国制订农业职业教育法提供相当有益的借鉴。这两部经典职业教育法以立法手段来规范、推动和促进农业职业教育事业的发展,措施内容翔实、具体,具有很强的可操作性。政府在投入大量资金的同时,也对资金的使用进行严格的监督。这些都是相当值得借鉴的立法经验。从这些立法经验当中,我们可以寻求出对制订我国的农业职业教育法有用的经验借鉴。各级政府部门应当对农业职业教育事业给予真正的重视,应当完善和健全保障农业职业教育事业发展的制度建设,措施的制订应当具体、翔实,具备可操作性,应当从法律制度的层面保障资金投入的数量,并切实保证资金的使用方向。 美国两部经典职业教育法——《莫雷尔法》和《史密斯-休斯法》为我国制订农业职业教育法提供了大量有益的立法经验。借鉴这些经验,笔者初步勾勒出我国农业职业教育法的基本框架和内容。这些框架和内容包括我国农业职业教育法的法律原则、法律性质、提供农业职业教育的主体、农业职业教育的适用范围、农业职业教育的经费安排、农业职业教育的层次、农业职业教育的证书制度、农业职业教育的监管体系和罚则。
