外资非正常撤离法律问题研究

【摘要】：2008年前后爆发的外资非正常撤离潮对我国的社会经济造成了严重的影响，不但极大地损害了我国的国家利益、我国公民的财产权益，而且影响了社会经济秩序的稳定。因此，如何正确认识外资非正常撤离事件，找到并解决其所引发的一系列法律问题，进而通过完善法律制度来抑制此类事件的再次爆发，是我们法律学习者所面临的重要任务。本文运用案例分析的方法，由案例引出论述主题。首先对外资非正常撤离的概念、原因及影响进行阐述分析。在此基础上本文归纳出外资非正常撤离所引发的三个主要法律问题，，分析与其相对应的现有法律制度的缺陷，尔后针对这些法律问题及其制度缺陷分别提出解决之道。最后，本文将对全文进行总结，结合我国利用外资的现状及现阶段外资政策，从事件源头管理角度提出预防外资非正常撤离的建议措施。
[Abstract]:The abnormal withdrawal of foreign capital around 2008 has had a serious impact on the social economy of our country, which has not only greatly damaged the national interests of our country, the property rights and interests of our citizens, but also affected the stability of the social and economic order. It is an important task for our law learners to correctly understand the abnormal evacuation of foreign capital, find and solve a series of legal problems caused by it, and then improve the legal system to restrain the recurrence of such incidents. This article uses the method of case analysis, from the case to lead to the theme. First of all, the concept of the abnormal withdrawal of foreign capital, On the basis of this, three main legal problems caused by the abnormal withdrawal of foreign capital are summarized, and the defects of the existing legal system are analyzed. Finally, this paper will sum up the full text, combining the current situation of foreign capital utilization and the current foreign investment policy in our country. From the point of view of incident source management, this paper puts forward some measures to prevent the abnormal withdrawal of foreign capital.
