集资房转让协议效力研究

【摘要】:自20世纪90年代,集资房在全国各地兴建而起,为当时的很多单位中低收入家庭解决了住房问题,但是随之而来大量的集资房纠纷也涌现了出来。时至如今,集资房纠纷越来越多,但由于缺少法律法规的明确规定,各家对于集资房纠纷中集资房转让协议的效力认识也不统一,从而在法院的具体处理中就出现了截然相反的结果。集资房转让协议作为合同的一类,属于民事法律关系调整的范畴,其最大的法律特征就体现在主体和内容的特殊性。集资建房是指在政府或主管部门的组织、扶持和单位支持下,采取由职工集聚资金、相互协作共同建设住房的方式,解决职工住房困难,具有合作性质的建房。它是改变住房建设由国家和单位统包的制度,,实行政府、单位、个人三者共同承担,通过筹集资金,进行住房建设的一种办法。《集资房转让协议》是指单位外个人与单位职工之间订立的集资房转让协议,就其性质而言,是作为平等主体之间设立、变更、终止民事权利义务关系的协议,在性质上是一种民事法律行为。集资房转让中出现的问题主要是单位职工和单位外的个人之间的转让过程中引发的纠纷。 集资房转让协议在其主体及其法律适用等方面存在众多的特殊性,从而导致在实践中集资房转让协议引发的纠纷越来越多。本文即是在此前提下针对集资房转让协议的特征入手展开分析和讨论,重点剖析集资房转让协议的效力问题,并于现行法律框架下,对于法律适用中存在的这些问题提出一些有针对性的建议和解决办法。
[Abstract]:Since 1990s, fund-raising houses have been built all over the country, which solved the housing problem for many low-income families at that time, but a large number of disputes have also sprung up. There are more and more disputes over fund-raising housing. However, due to the lack of clear provisions of laws and regulations, the validity of the agreement on the transfer of fund-raising housing in the disputes over fund-raising housing is not uniform. As a result, in the specific handling of the court, there has been a diametrically opposite result. As a kind of contract, the agreement on the transfer of the financing house belongs to the scope of the adjustment of civil legal relations. The biggest legal feature is the particularity of the main body and the content. Building houses by raising funds means, with the support, support and support of the government or competent departments, to adopt the way of building housing by the staff and workers to gather funds and cooperate with each other to build housing. To solve the housing difficulties of workers and staff, and to build houses of a cooperative nature. It is to change the system of housing construction by the state and the units, to implement the joint undertaking of the government, the units and the individuals, and to raise funds by raising funds. A method for housing construction. The "Agreement on the transfer of financed Houses" refers to the agreement on the transfer of financed housing concluded between individuals outside the unit and the employees of the unit. In terms of its nature, it is set up and changed as an equal subject. The agreement to terminate the relationship between civil rights and obligations is a civil legal act in nature. There are many particularities in the agreement on the transfer of financing houses in the aspects of its subject and the application of the law. As a result, there are more and more disputes caused by the agreement on the transfer of the financing house in practice. This paper analyzes and discusses the characteristics of the agreement on the transfer of the financing house under this premise, focusing on the analysis of the validity of the agreement on the transfer of the financing house. Under the current legal framework, some suggestions and solutions to these problems in the application of the law are put forward.
