论宋代官员的鬼神信仰对其司法实践的影响——以杀人祭鬼案件为中心

【摘要】：两宋时期,官员有不少表达对杀人祭鬼的治理重视之话语,但实践中真正予以治理的例子却非常少见。通过借用布尔迪厄的"场域"概念进行分析可见,此矛盾的一个重要原因,在于官员的鬼神信仰令其相信并惧怕杀人祭鬼者所可能带来的危险和威胁,因而在司法实践中倾向于忽视杀人祭鬼案件的存在。由此可见,宋代官员的鬼神信仰确实会对其司法实践造成影响。
[Abstract]:During the Song Dynasty, officials expressed a lot of words of attaching importance to the governance of murderers, but the examples of real governance in practice were very rare. Through the analysis of Bourdieu's concept of "field", it can be seen that, An important reason for this contradiction is that the official's belief in ghosts and gods makes them believe in and fear the dangers and threats that may be brought about by those who kill and sacrifice ghosts, so they tend to ignore the existence of cases of killing and sacrificing ghosts in judicial practice. The official's belief in ghosts and gods in the Song Dynasty did have an impact on their judicial practice.
