美国出口管制法及对中美经济贸易影响的法律分析

【摘要】：在全球经济一体化的今天,美国对华严苛的出口管制已经严重阻碍了中国高科技发展和加入全球经济的步伐。本文旨在通过对美国出口管制法体系的介绍,分析其对中美经济的影响,并寻求解决方案。本文首先对与美国的整个出口管制法体系的历史、发展、内容和实施进行了系统的介绍,使大家对于美国的出口管制法有了一个较为直观的了解。然后本文着重对于美国对华出口管制的历史和现状进行了介绍,并分析了美国对华出口管制对于中美双方经济发展的影响,指出美国的对华出口管制不仅对于中国的技术引进和发展带来了非常大的制约,对其自身的经济和贸易发展也造成了很不利的影响,成为中美贸易逆差的主要诱因,并严重阻碍了中美贸易关系的和谐发展。通过对美国出口管制法造成的不利影响的分析,本文还进一步指出美国的出口管制法已经不符合国际社会发展的趋势,不符合中美双方合作和贸易平衡的需要,对美国出口管制法的未来发展,改革和放宽已经是势在必行,否则必将在中国的广阔市场失去竞争力。在本文的最后,是关于中国对美国出口管制法体系的对策和策略,指出中国的发展不能够依赖于美国自己对出口管制的放松,而应该从更多的渠道来引进先进的产品和技术,同时,通过更积极的手段来促进美国放松对华出口管制。并指出,中国的未来更多地还是要靠自己的发展,这才是中国最终和最好的发展之路。
[Abstract]:In today's global economic integration, the strict export controls imposed by the United States on China have seriously hindered China's high-tech development and the pace of its entry into the global economy. First of all, this paper introduces the history, development, content and implementation of the entire export control law system with the United States. So that everyone has a more intuitive understanding of the export control laws of the United States. Then, this paper focuses on the history and current situation of US export control to China. It also analyzes the impact of US export control to China on the economic development of both China and the United States, and points out that US export control to China has not only brought great constraints to China's technology introduction and development. It has also had a very negative impact on its own economic and trade development, which has become the main cause of the Sino-US trade deficit, and has seriously hindered the harmonious development of Sino-US trade relations. Through an analysis of the adverse effects of the United States export control law, The article further points out that the export control law of the United States has not been in line with the trend of the development of the international community, and does not meet the needs of Sino-American cooperation and trade balance. It is imperative for the future development of the United States export control law to reform and relax. Otherwise, it will lose its competitiveness in China's vast market. At the end of this paper, it is about the countermeasures and strategies of China's export control law system to the United States, pointing out that China's development cannot depend on the relaxation of export control by the United States itself. Instead, we should introduce advanced products and technologies from more channels, and at the same time, promote the United States to relax its export controls to China through more active means. It also points out that China's future depends more on its own development. This is the ultimate and best way for China to develop.
