在法感情与法秩序之间

【摘要】：一般说来,法律秩序是一种具有特殊强制力的社会状态,为社会提供确定性、一致性,为社会主体提供安全保障,为社会关系提供可依循的界限和规则。然而,此种关于法律秩序的论说,虽然指出了法律作为一种制度在社会秩序形成与发展中的作用,却忽视了法感情对于守法行为以及守法者的意义。也正因如此,中国几十年法制建设虽收获颇丰,却大都仅限于书本层面与法律人口号式的呐喊中,而现实中法律秩序之构建并不理想。基于此,本文将以法感情缺失为进路,寻探社会生活中法律秩序未能形成之原因,为社会法秩序之构建与践行提供参考。
[Abstract]:Generally speaking, legal order is a kind of social state with special coercive power, which provides certainty and consistency for society, security for social subjects, boundaries and rules for social relations. This argument on legal order, while pointing out the role of law as a system in the formation and development of social order, ignores the significance of legal feelings for law-abiding behaviour and law-abiding persons. Although the legal system construction in China has gained a lot in the past decades, it is mostly confined to the slogan cry of the book and the legal person, but the construction of the legal order in reality is not ideal. Based on this, this paper will take the lack of legal feelings as the way to go. To find out the reasons why the legal order in social life has not been formed, and to provide reference for the construction and practice of social legal order.
