张謇与清末宪政史知识的译介与传播

【摘要】：20世纪初年在仿效西方和日本实行立宪改革这一点上,中国的官方和民间已经取得了基本的共识,但对中国的立宪道路应采取"虚君立宪"的英国模式还是"实君立宪"的日本模式仍然意见不一。张謇没有明确提出过中国的立宪政体究竟应该采取"英国模式"抑或"日本模式",而是在其主持下的翰墨林书局首先将《日本议会史》和《英国国会史》译成汉语,将两种模式的宪政知识传输给国人。从对作为西方立宪政治源头、典范的英国宪政历史模式,到作为东方仿行宪政成功典范的日本宪政历史模式的考察,以及对宪政思想和实践的中学源流的研究,构成了清末对宪政思想及其历史的相对完整且多视角的认知体系。正是由于在张謇主持译刊的宪政与宪政史译著的相继问世,不仅为近代中国的宪政理论的建构和实践的运作,提供了丰富的知识资源,而且启发和带动了清末宪政史一波又一波的译刊高潮。
