“变性人”法律问题初探

【摘要】： “变性人”是指通过变性手术使自己的生物性别与心理性别达到一致的人,他们不同于以着异性服装为癖好的“异装癖”及以同性为性对象的“同性恋”。有数据显示,我国约有40万人要求进行变性手术,已经有一千余人实施了手术。本文首先介绍了“变性人”的概念、产生原因、发展历史及其现状,其中以美国为例,重点介绍了“变性人”这一特殊群体在教育、就业、医疗保险等领域所受到的歧视;文章随后分析了“变性人”在我国现实社会生活中可能或者已经遇见的具体法律问题,比如民事法律上的“变性人”能否结婚、婚后变性的婚姻效力以及变性后和子女的关系该如何处理;刑事法律上的“变性人”是否可以构成“强奸罪”的主体或犯罪对象;行政法律上的“变性人”的性别到底该如何确定,其权利受到行政机关侵犯时该如何救济,以及“变性人”在其他一些法律关系中的权利义务该如何确定等问题,并尝试性的给予了一些对策分析;最后,也是本文的最终目的,就是首先对“变性人”产生的源头——变性手术进行立法限制,设定变性手术的实施条件、实施程序等,然后试图在民事法、刑事法、行政法以及其他具体法律中给出具体的立法建议,用具有全国性普遍适用效力的法律法规来规制“变性人”这一特殊群体应有的权利义务,改变目前对于“变性人”的相关问题仅由相关政府部门针对特定事项、特定区域发布“批复”解决问题的现状,从而更好、更全面的维护“变性人”的权益。
