权威认同、纠纷及其解决机制的选择——法社会学视野下的中国经验

【摘要】：社会结构与秩序中有权威的存在,权威认同正是对这一存在的主观认识和态度。综合社会调查显示居民的权威认同具有多元化特征,且与纠纷解决机制选择行为相分离。纠纷当事者选择权威介入的纠纷解决方式,既不是因为对该权威有更高的认同度,也主要不是因为拥有更多资源能够利用该权威,而是因为对该权威解决特定类型纠纷的有效性具有理想预期,这种对权威有效性的预期其实是基于权威与特定类型纠纷之间的关联而形成的。
[Abstract]:The existence of authority in social structure and order is the subjective cognition and attitude towards this existence. The comprehensive social survey shows that the identity of authority of residents has pluralistic characteristics. And it is separated from the behavior of the choice of dispute resolution mechanism. The parties to the dispute choose the method of dispute resolution in which the authority intervenes, neither because they have a higher degree of approval of the authority, nor because they have more resources to make use of the authority. It is because there is an ideal expectation on the validity of the authority to resolve a particular type of dispute, which is actually based on the relationship between authority and a particular type of dispute.
