德国民法典规定一体化消费者概念的意义及借鉴

【摘要】：《德国民法典》在总则中规定消费者一体化的概念,刻意强调保护消费者法的私法属性,刻意强调消费者地位的特殊性,刻意强调消费者与经营者相对应以确定倾斜的消费者保护政策,刻意强调提升消费者法的品性实现再法典化,具有重要的借鉴意义。中国民法应当借制定民法总则的机遇,在民事主体中规定一体化的消费者概念,确定"消费者—经营者"关系与"非消费者—经营者"关系的分类,适用不同的民法规则,补足消费者的弱势地位,实现消费者法归属于民法体系,更好地保护消费者的目的。
[Abstract]:The German Civil Code stipulates the concept of consumer integration in the general principles, emphasizes the private law attribute of consumer protection law, and emphasizes the particularity of consumer status. It is of great significance to emphasize the correspondence between consumers and operators in order to determine the inclined consumer protection policy and to promote the character of consumer law to be recodified. China's civil law should take advantage of the opportunity of formulating general principles of civil law. The concept of integrated consumer is defined in the civil subject, the classification of the relationship between "consumer-operator" and "non-consumer-operator" is determined, and different civil law rules are applied to complement the weak position of consumers. To achieve the purpose of consumer law belonging to the civil law system and better protect consumers.
