从日本核电站事件谈国家对邻国的环境责任

【摘要】：日本福岛核泄漏对周边国家造成了跨境环境污染损害。东京电力公司是损害发生的行为者,因此,应当承担相应的责任。但是最终承担主体应当是国家。本文将从日本核辐射这一具体事件展开去谈国家对邻国的环境责任。文章的目的在于通过阐述国家因其违反国际环境义务而对其邻国产生的国家责任。通过这次日本福岛核电站泄漏事件为选题的切入点,着重阐述一个国家环境污染给周边国家带来的影响,及在此过程中,国家应当承担的国家环境责任、国家义务及国际法当中对国家环境责任的要求和相关国家责任间的国际条约和准则。最终目的是为了完善及更好的实现国家的环境责任。
[Abstract]:The Fukushima nuclear leak in Japan has caused transboundary environmental pollution damage to neighboring countries.Tepco is the perpetrator of the damage and should therefore be held responsible.But the ultimate undertaking should be the state.This paper will talk about the environmental responsibility of the country to the neighboring country from the specific incident of Japan's nuclear radiation.The purpose of this paper is to expound the national responsibility of the state to its neighbors for violating its international environmental obligations.By using the Fukushima nuclear power plant leakage incident in Japan as the entry point of the topic, this paper focuses on the impact of a country's environmental pollution on the neighboring countries, and the national environmental responsibility that the state should bear in the process.State obligations and international treaties and norms relating to national environmental responsibilities under international law.The ultimate goal is to improve and better realize the country's environmental responsibility.
