社会转型视角下的当代中国法治文化建设

【摘要】：当代中国正经历着经济体制、政治制度、文化模式的巨大转型，而与此相适应，中国法治文化也在发生历史性转型。法治文化研究受到了越来越多学者的关注，法治文化建设成为当前研究的一个重要课题。建设法治国家，要有先进的文化理论做先行指导，而我国法治传统相对匮乏，要建成社会主义法治国家，必须从中国国情出发，借鉴吸收西方国家合理的法治实践成果，既要借鉴有益成果又不简单照搬照抄，总结实践经验，形成有益理论用来指导实践，以独特的文化视野找到适合我国法治文化构建的有效路径，最终建成社会主义法治国家。 本文首先交代了研究的缘由和意义、国内外研究现状、研究思路和方法以及创新点、不足等。在梳理文献的基础上，厘定了法治文化的内涵，交代了法治文化的主要内容；作为一种特殊的文化形态，法治文化的基本要素主要包括民主法治、自由平等、公平正义等意识，在社会转型视角下，它出现了更为丰富的内涵特质。为此，非常有必要对新时期，特别是改革开放以来我国社会主义法治文化建设的成就和存在的问题进行系统化的梳理和探究，故而深入研究转型期我国的法治文化建设也就有其必要性和重要性诉求。中国特色的法治理念是依法治国、执法为民、公平正义、服务大局和党的领导，这就为转型期社会主义法治文化培植指明了基本的方向，但是中国法治文化建设面临着缺乏法治传统、实践经验不足等客观问题，，为此，探求中国法治文化蕴涵的基本价值，合理吸收西方法治实践中的重要因素，探索出实现法治国家建设所要解决的问题，提出转型期我国法治文化建设的具体路径，就成为了本文研究的出发点和归宿。
[Abstract]:Contemporary China is undergoing a great transformation of economic system, political system and cultural model, and the culture of rule of law in China is undergoing a historic transformation. More and more scholars pay attention to the study of the culture of rule of law. The construction of the culture of rule of law has become an important subject of current research. In order to build a country ruled by law, it is necessary to have advanced cultural theories to guide it first, while the tradition of rule of law in our country is relatively scarce. In order to build a socialist country ruled by law, we must proceed from China's national conditions. Drawing lessons from and absorbing the reasonable practical achievements of the rule of law in western countries, we should draw lessons from the beneficial results and not simply copy them, sum up the practical experience, and form useful theories to guide the practice. To find an effective path suitable for the construction of the culture of rule of law in our country with the unique cultural vision, and finally to build a socialist country ruled by law. Firstly, this paper explains the reason and significance of the research, the present situation of the research at home and abroad, the ideas and methods of the research, the innovation points and shortcomings, etc. On the basis of combing the literature, it defines the connotation of the culture of the rule of law and explains the main contents of the culture of the rule of law; As a special cultural form, the basic elements of the culture of rule of law mainly include the consciousness of democracy and rule of law, freedom and equality, fairness and justice. It is very necessary to systematize and explore the achievements and problems in the construction of socialist rule of law culture in the new period, especially since the reform and opening up. Therefore, it is necessary and important to deeply study the construction of the culture of rule of law in our country during the transition period. The idea of rule of law with Chinese characteristics is to rule the country according to law, enforce the law for the people, be fair and just, serve the overall situation and the leadership of the Party. This has pointed out the basic direction for the socialist culture of rule of law in the transitional period, but the construction of the culture of rule of law in China is faced with some objective problems, such as the lack of tradition of rule of law and the lack of practical experience. Therefore, the basic value of the culture of rule of law in China is explored. Reasonable absorption of the important factors in the practice of the rule of law in the west, exploring the problems to be solved in the construction of the country ruled by law, and putting forward the concrete path of the construction of the culture of rule of law in our country during the transition period, has become the starting point and the destination of the research in this paper.
