【摘要】： 本文取材于现实生活中一个真实的案例,笔者根据检察机关对被告贾某起诉的四项罪名中所涉及的刑事法律问题有所节选的进行了讨论。笔者以贾某的每一项罪名为基础,在提出案情疑问的同时运用自己所学的和从参考文献中借鉴的知识对疑点问题给出了自己的观点和评述,同时针对本案中出现的新问题、新情况提出了自己的建议和看法。本文所涉及的刑事司法问题不仅包含了刑法总则和分则的问题,还包括了实体法和程序法的问题。笔者希望借此文章,对案件中涉及的一些刑法问题做一个简单的探讨。
[Abstract]:Based on a real case in real life, the author discusses the criminal legal issues involved in the four charges indicted by the defendant Jia.On the basis of every charge of Jia Mou, the author puts forward his own views and comments on the doubtful points by using the knowledge he has learned and the knowledge he has learned from the reference literature while raising questions about the case, and at the same time, aiming at the new problems that appear in this case,The new situation puts forward its own suggestions and opinions.The criminal justice issues involved in this paper include not only the general principles and sub-rules of criminal law, but also substantive law and procedural law.The author hopes to use this article to make a brief discussion on some criminal law problems involved in the case.
