日本违宪审查制度对特别权力关系中的人权保障

【摘要】：特别权力关系，是国家和公民之间的一种特殊关系，其给予了行政主体相当大的自由裁量权，并且通过内部规范来限制基本权利，在内部寻求救济。我国尊重和保障人权，而这些特别权力关系中的人受到侵害的情形却常常容易被人忽视。这与保障人权的相关配套机制不健全有着极大的关系。如今在我国，围绕着违宪审查制度，这一人权救济机制的设立及其模式还存在着种种争论，，很多学者都对发达国家，比如说美国的司法审查模式、法国的宪政院模式等进行了详细的探讨，对于一衣带水的日本，其违宪审查模式，特别是其中对特别权力关系中的人权保障问题更是很少有人提及。因此，本文通过对日本违宪审查的案例进行归类分析，结合涉及公务员、被关押者、高校学生的相关案例，找出在保障这些特殊主体的基本人权的方法、理论等，并结合我国案例，试图给我国提供一定的借鉴和参考。
[Abstract]:The special power relationship is a special relationship between the state and the citizen, which gives the administrative subject considerable discretion, and limits the basic right through the internal norm, and seeks the relief internally.Human rights are respected and protected in our country, and violations of these special power relationships are often overlooked.This has a great relationship with the imperfect supporting mechanism of protecting human rights.Nowadays, in our country, around the system of unconstitutional review, there are still various arguments about the establishment and mode of the human rights relief mechanism. Many scholars have expressed their views on the judicial review model of developed countries, such as the United States.The mode of constitutional court in France is discussed in detail. For Japan, whose unconstitutional review mode, especially the human rights protection in the special power relationship, is seldom mentioned.Therefore, by classifying and analyzing the cases of Japan's unconstitutional review, combining with the relevant cases involving civil servants, detainees and college students, this paper finds out the methods and theories to protect the basic human rights of these special subjects.And combine our country case, try to provide certain reference and reference to our country.
