俄罗斯国际商事仲裁法律制度研究

【摘要】： 随着经济全球化的进一步发展,国际商事主体更多地选择国际商事仲裁解决争议。本文首先就国际商事仲裁制度在国际上的立法及适用作了简要介绍。其次,俄罗斯作为转轨的资本主义制度国家,其立法构建与国际接轨,在许多制度上都值得我国借鉴。因此,本文结合了《俄罗斯联邦国际商事仲裁法》(1993年)、《俄罗斯联邦仲裁程序法典》(2002年9月1日生效)、现行《俄罗斯联邦工商会国际商事仲裁院仲裁规则》(1995年5月1日生效)及俄罗斯仲裁机构的实践,就俄罗斯国际商事仲裁的历史沿革、仲裁规则及适用、仲裁裁决的承认与执行等方面进行分析,论述了俄罗斯国际商事仲裁法律制度对我国国际商事仲裁制度的启示,并提出了构建基本框架、完善启动制度等建议。
[Abstract]:With the further development of economic globalization, international commercial subjects choose international commercial arbitration to settle disputes.In this paper, the international commercial arbitration system in the international legislation and application made a brief introduction.Secondly, Russia, as a transitional capitalist country, its legislation construction and international integration, in many systems are worthy of our country's reference.Therefore,This article combines the Law on International Commercial Arbitration of the Russian Federation (1993) (1993, Code of Arbitration procedure of the Russian Federation) (entered into force on 1 September 2002), the current Arbitration rules of the International Commercial Arbitration Court of the Russian Federation Chamber of Commerce and Industry (born on 1 May 1995).And the practice of Russian arbitration institutions,This paper analyzes the history of Russian international commercial arbitration, the arbitration rules and its application, the recognition and enforcement of arbitral awards, and discusses the enlightenment of the Russian international commercial arbitration legal system to our country's international commercial arbitration system.And put forward the construction of basic framework, improve the startup system and other suggestions.
