“人肉搜索”所致诽谤罪责任的法律探讨

【摘要】："人肉搜索"作为一种独特的网络现象,在发挥弘扬社会道德、舆论监督、协助侦破案件等正面功能的同时,也时常伴随着侵犯公民个人权利、损害政府公信力等负面影响的出现。刑法诽谤罪可以有效地规范"人肉搜索"行为,防止"人肉搜索"为网络暴力所利用。文章由"人肉搜索"司法第一案引申思考,详细分析了诽谤罪的法律构成,并对"人肉搜索"中各主体的诽谤罪责任进行了探讨,提出了立法建议。
[Abstract]:"Human flesh search", as a unique network phenomenon, plays a positive role in promoting social morality, supervision by public opinion, assisting in the detection of cases, and so on, at the same time, it is often accompanied by infringement of the individual rights of citizens.Damage to the credibility of the government and other negative effects appear.Criminal libel can effectively regulate "human flesh search" and prevent "human flesh search" from being exploited by network violence.From the first judicial case of "Human flesh search", this paper analyzes the legal constitution of libel in detail, probes into the libel liability of each subject in "Human flesh search", and puts forward some legislative suggestions.
