封闭叙述与开放叙述:法律的两种电视话语再现

【摘要】：本文在对法律制度自身发展和其大众化过程中两对矛盾分析的基础上,分别考察了在中国电视屏幕上流行的"电视法制社教节目"和"法制题材电视剧"两种话语方式。通过比较分析它们在叙述过程中不同的诉求、手段和效果,电视社教法制节目通过相对封闭的叙述方式,将故事纳入法律的解释体系,可能弥合"应然之法"与"实然之法"之间的矛盾;法制题材电视剧则将法律融入更为广阔的社会语境,从而为现实生活与法律规则之间的矛盾共生提供一个相对开放的电视文本。
[Abstract]:Based on the analysis of two pairs of contradictions in the development of the legal system itself and its popularization, this paper examines the two discourse modes of "TV legal Social Education Program" and "legal subject TV Series", which are popular on Chinese television screens.Through the comparative analysis of their different demands, means and effects in the narrative process, TV social education and legal programs bring the story into the legal interpretation system through a relatively closed narrative method.It is possible to bridge the contradiction between the "law of what ought to be" and the "law of reality", while TV dramas on the subject of legal system will integrate the law into a broader social context,Thus provides a relatively open TV text for the contradiction between real life and legal rules.
