民国时期《湖南省宪法》若干问题研究

【摘要】： 《湖南省宪法》的出台是多种因素共同作用的结果：思想上,联邦制思想、地方自治思想和民主宪政思想为其提供了理论基础；政治上,军阀割据与军阀混战不断,中央政权势微,湖南自治情势日益明朗；经济上,几千年来以自然经济为主导、商品经济不发达的经济格局未有根本改观；同时,随着社会变迁的不断推移,社会政治权力重新分化组合,各种寻求自治的社会组织直接推动了自治进程。《湖南省宪法》体现的宪法理念主要有：主权在民,权利本位,权力法定,权力有限,地方自治。《湖南省宪法》不仅对人民权利与公共权力之序位予以巧妙安排,而且非常重视从权利的种类、范围、保障途径等方面进行详细规定,充分体现了“权利本位”的制宪理念,突出了人民权利的重要性。《湖南省宪法》出台的目的之一是为湖南立宪自治提供正当性法律基础,培育民主组织,培养民众民主习惯,以求夯实民治根基。《湖南省宪法》既注重划分中央与省级的权力界限,明确省自治权力,又注重划分省级与地方的权力界限,明确地方自治制度。《湖南省宪法》规定建立共和政体,采取三权分立的政权组织形式,对立法权、行政权和司法权予以详细规定,注重三者之间的制约与平衡。作为联省自治运动共同的产物,《湖南省宪法》与同时代的《浙江省宪法》和《福建省宪法》有许多相似之处；因为各省省情的不同,三者又有诸多不同的地方,具体体现在权利保障的程度与方式、省自治和地方自治建构的程度与方式、三权分立政治结构的具体组成及运行状况等方面。
[Abstract]:The introduction of the "Constitution of Hunan Province" is the result of the joint action of many factors: ideologically, federalism, local autonomy and democratic constitutionalism provide it with a theoretical foundation, politically, warlord separation and warlords are constantly fighting, The situation of Hunan's autonomy has become increasingly clear as the power of the central government has been weak; economically, the economic pattern of underdeveloped commodity economy has not fundamentally changed for thousands of years, with the natural economy dominating; at the same time, as the social changes have continued, The redifferentiation and combination of social political power and various social organizations seeking autonomy directly promote the process of autonomy. The Constitution of Hunan Province embodies the following constitutional concepts: sovereignty in the people, right standard, legal power, limited power and local autonomy. The Constitution of Hunan Province not only cleverly arranges the order of people's rights and public power, but also attaches great importance to the detailed regulation of the types, scope, and ways of protection of rights, which fully embodies the constitution-making concept of "rights-oriented". The importance of people's rights was highlighted. One of the purposes of the introduction of the "Constitution of Hunan Province" is to provide a legitimate legal basis for Hunan's constitutional autonomy, to cultivate democratic organizations, and to cultivate the democratic habits of the people. In order to consolidate the foundation of the rule by the people, the Constitution of Hunan Province not only pays attention to dividing the limits of power between the central government and the provincial level, but also to defining the power limits of provincial and local governments, as well as the system of local autonomy. The Constitution of Hunan Province provides for the establishment of a Republican system of government, which shall be organized in the form of the separation of three powers of power, with detailed provisions on legislative power, executive power and judicial power, paying attention to the restriction and balance among the three powers. As a common product of the autonomous movement of the United provinces, the Constitution of Hunan Province has many similarities with the contemporary Constitution of Zhejiang Province and the Constitution of Fujian Province. It is embodied in the degree and mode of right guarantee, the degree and mode of the construction of provincial autonomy and local autonomy, the concrete composition and operation of the political structure of the separation of powers.
