法的人性基础研究

【摘要】： 人性问题是一个长期困扰人类的难题。人性是什么?本善还是本恶?人性与法律之间有什么关系?在建设现代法治社会的过程中我们该怎样看待人性?对于人性,几千年来中外贤哲给出了多种不同的答案,不同的回答,导致了不同的文化传统,演变成了不同的社会制度。本文在对人性讨论的基础上,试图对上述问题做理论上的阐述和探讨。以期探寻法律存在的人性基础。本文首先从分析人性的内涵入手,认为人性的内涵包括两部分即:人的自然本性和社会本性。然后通过对人性善恶问题的梳理,得出了人性是善与恶的统一。然后进一步分析了人性与法律之间的关系,得出了人性之恶使法律的产生成为必要,而人性之善使法律的存在成为可能。人性的生存和发展需要是法律发展的原动力,对人性认识的差异导致了法律发展类型的不同,西方基于人性本恶的认识走上了“以恶制恶”法治道路,而中国基于人性本善的预设,趋向于走以伦理教化为主导的德治之路。人的自然本性与社会本性与法的价值有着内在的关联,本文在分析人性与法的价值之基础上,具体探讨了人的个体性与自由,人的社会性与秩序,以及人性的平衡与正义之间的关系,得出法的价值也是建立在人性基础之上的。
[Abstract]:The question of human nature is a difficult problem that has plagued mankind for a long time. What's human nature? Good or evil? What is the relationship between human nature and law? How should we treat human nature in the process of building a modern society ruled by law? For human nature, Chinese and foreign philosophers have given different answers and different answers for thousands of years, which have led to different cultural traditions and evolved into different social systems. Based on the discussion of human nature, this paper attempts to make a theoretical exposition and discussion on the above problems. In order to explore the human basis of legal existence. This paper begins with the analysis of the connotation of human nature, and concludes that the connotation of human nature consists of two parts: human nature and social nature. Then through combing the problem of good and evil of human nature, we draw the conclusion that human nature is the unity of good and evil. Then it further analyzes the relationship between human nature and law, and concludes that the evil of human nature makes the emergence of law necessary, and the good of human nature makes the existence of law possible. The existence and development of human nature is the driving force of the development of law. The difference in understanding of human nature leads to different types of legal development. The western understanding of human nature based on the nature of evil has taken the road of "using evil to control evil" and ruling by law. Based on the presupposition of human nature, China tends to follow the road of moral governance dominated by ethics. The natural nature of man and the value of law are intrinsically related. On the basis of analyzing the value of human nature and law, this paper discusses the individuality and freedom of human beings, the sociality and order of human beings. And the relationship between the balance of human nature and justice, the value of law is also based on human nature.
