汉代边防法律的社会控制功能——以汉简研究为中心

【摘要】：两汉时期的边疆地区所设置的津关以及边塞系统是维护国家安全的重要屏障。本文以西北地区出土的汉简研究为中心,着重阐述法律作为边疆社会重要的管理手段之一,在人身监控、对官吏的制约方面实现了汉政府对人的管理;在战略物资的管制、边地事务的管理方面实现了汉政府对物和事的管理。法律在边疆地区的管理中发挥了重要的社会控制功能。
[Abstract]:Jin Guan and frontier fortress system set up in the border area of Han Dynasty are important barriers to maintain national security. Focusing on the study of Han bamboo slips unearthed in Northwest China, this paper emphasizes that the law, as one of the important management means of the frontier society, has realized the management of people in the aspect of personal supervision and restriction to officials, and the control of strategic goods and materials. The management of frontier affairs realized the management of things and things by the Han government. Law plays an important role of social control in the management of frontier areas.
