德国行政诉讼中司法权的边界及其成因

【摘要】：德国行政诉讼中法院的受案范围非常广泛;法院一般可以主动、全面、深入地审查案件中的事实问题、行政裁量权问题以及法律问题等,无须尊重行政机关的专业知识与经验。不过,自上个世纪70年代以来,随着有关解释不确定法律概念的理论的发展,德国行政法院对行政机关进行强势监督与制约的格局有所松动。同时,值得注意的是,行政法院在判决与执行中恪守权力分立的原则。德国行政诉讼中司法权边界的形成,是与其宪政体制、法院分工格局、法定法官原则、二战后对公民权利的重视以及发达的公法理论等紧密相关的。
[Abstract]:The range of cases accepted by the courts in administrative proceedings in Germany is very wide; the courts can generally take the initiative, comprehensively and thoroughly examine the factual issues, administrative discretion issues and legal issues in the cases, and need not respect the professional knowledge and experience of the administrative organs. However, since the 1970s, with the development of the theory on the interpretation of uncertain legal concepts, the pattern of strong supervision and restriction of administrative organs by the German Administrative Court has been loosened. At the same time, it is worth noting that the Administrative Court abides by the principle of separation of powers in judgment and execution. The formation of the boundary of judicial power in administrative litigation in Germany is closely related to its constitutional system, the pattern of division of labor in courts, the principle of statutory judges, the emphasis on civil rights after World War II and the developed theory of public law.
