网络时代公共舆论的法治功能

【摘要】： 随着网络技术的发展,网络公共舆论也随之出现,并对政治的决策和社会公共事务的运行产生很大的影响。网络公共舆论同时也是民意的载体,是反映民意表达民意的平台,而且给予了网民充分的话语权。在维护公民权利、限制公权力培养公民法治精神方面网络公共舆论也起到了促进作用,同时也促进了我国的法治进程。但是现在我国网络公共舆论并不是很规范,其中存在着很多虚假言论、不理性言论、网络侵权现象,其根本原因就是网民的公民性素质有待提高。要解决类似问题就要从制度上和机制上来规制网络公共舆论。对网络公共舆论不能采用放任的态度,要内外结合的规制网络公共舆论,从内部促使网民自律、外部制定网络法规,使网络公共舆论的理论功能得到发挥,这样才能推进我国的法治进程。
[Abstract]:With the development of network technology, network public opinion also appears, and has a great influence on the political decision-making and the operation of social public affairs. Network public opinion is also the carrier of public opinion, which is the platform to reflect public opinion, and gives Internet users full right to speak. The network public opinion has also played a promoting role in safeguarding citizens' rights and restricting public power to cultivate citizens' spirit of ruling by law, at the same time, it has also promoted the process of ruling by law in our country. But now the public opinion of network in our country is not very standard, among which there are many false speech, irrational speech, network tort phenomenon, the fundamental reason is that the citizen quality of the netizen needs to be improved. To solve similar problems, we should regulate network public opinion from the system and mechanism. To the network public opinion cannot adopt the laissez-faire attitude, must combine the internal and external regulation network public opinion, from the inside urges the netizen self-discipline, outside formulates the network laws and regulations, causes the network public opinion theory function to be brought into play. Only in this way can we advance the process of rule of law in our country.
