社会权的法理刍议

【摘要】： 社会权作为晚近诞生的新型权利,在学界尚存争议。从公权利与私权利、积极权与消极权、个别权与普遍权这三重维度对社会权加以审视有助于增进对社会权性质的认识。追寻社会权在古代社会、中世纪、近代和现代不断闪现的身影,深感社会权历史之悠远,人类情怀之可贵。社会权的反对意见亦紧紧跟随,给人以警醒。从人性根基、理论支撑、实践支撑三个层面给社会权以理论证成,深感社会权思想积淀之厚实,精神内核之丰盈。社会权的具体内容包括社会保障权、劳动权、受教育权等,关涉有尊严的生活能否达至。“人是普遍的弱者”,人皆有成为弱者的可能。社会权关照的,是茫茫人海中的每一个人。
[Abstract]:As a new type of rights, social rights are still controversial in academic circles. It is helpful to improve the understanding of the nature of social rights from the perspectives of public and private rights, positive rights and negative rights, individual rights and universal rights. The pursuit of social rights in ancient society, the Middle Ages, modern times and modern constantly flashed out, deeply felt the history of social rights and the value of human feelings. The opposition to social rights followed closely, alerting people. From the human nature foundation, the theory support, the practice support three aspects to the social right to the reason argument, deeply feels the social right thought accumulation thick, the spiritual core is abundant. The specific contents of social rights include the right to social security, the right to work, the right to education and so on. "Man is the general weak", and all people have the possibility of becoming weak. Social rights care for everyone in the vast crowd.
