我国地方立法质量路径问题研究

【摘要】： 在我国社会主义发展进程中,加强地方立法工作,提高地方立法质量已经成为我国立法工作的当务之急。近年来,随着立法行为在社会的需求中的增大,虽然制定了大量的地方性法规,取得了很大的成绩,但地方立法质量普遍较低,从中暴露出了许多问题。为提高地方立法质量,我们要找出解决问题的方法并加以完善。只有完善地方立法质量,才能推进我国社会主义法律体系的建设。 本文首先介绍了我国地方立法质量的基本理论;接着对西方国家地方立法权限划分标准和地方立法程序的情况进行了比较借鉴;然后从地方立法质量存在的问题和影响的因素这两方面分析我国目前地方立法质量的现状;最后提出了对提高我国地方立法质量的几点建议并加以完善。
[Abstract]:In the process of socialist development in China, strengthening local legislation and improving the quality of local legislation have become the urgent task of our country's legislative work. In recent years, with the increase of the social demand, a large number of local laws and regulations have been made and great achievements have been made, but the quality of local legislation is generally low. In order to improve the quality of local legislation, we should find ways to solve the problem and improve it. Only by improving the quality of local legislation can we promote the construction of the socialist legal system in our country.
This article first introduces the basic theory of the quality of local legislation in China, and then makes a comparison of the criteria for the division of local legislative authority and the local legislative procedure in western countries, and then analyzes the present situation of the quality of the local legislation in China from the two aspects of the existing problems of the quality of the local legislation and the factors affecting it. Several suggestions for improving the quality of local legislation in China are put forward.
