【摘要】: 传统的立法理论重视立法过程、立法权限、立法技术等立法学基本问题的研究,虽然这些基本问题是立法理论研究不可或缺的因素,对立法质量的提高有很大的意义,但是单纯研究这些问题,已经不能解决和协调不同时期、不同部门法律法规之间的矛盾和冲突。法律法规质量好不好,归根结底是看法律法规的适用情况,看法律法规是否能够经受实践的考验,达到预期的效果。这就要求立法机关在法规适用阶段进一步关注其实施情况,做到心中有数,在必要时予以修改,以适应经济、社会发展的需要。因此开展立法后评估工作势在必行。 而构建立法后评估指标体系是开展立法后评估的核心义项。在立法后评估中,评估指标起到风向标的作用。指标体系科学合理,可以正确反映立法的效果和效益,引导立法工作的良性发展;指标体系设计不尽合理,则有可能误导对制度与规范的选择。构建评估指标体系是立法后评估活动中非常重要的工作。评估指标体系能够为立法后评估提供科学、客观的尺度和标准,是评估取得实效的有力保障,并可对日常立法工作起到引导作用。因此,加强立法后评估指标体系的研究具有重大的意义和价值。 立法后评估制度在国外早已成为定制。而国内对立法后评估制度的研究才刚刚起步,虽然实践中已经有不少的地方开展了立法后评估,但是在理论界,学者们的研究主要集中在对立法后评估概念的界定、分析立法后评估制度产生的原因及意义、立法后评估的方式等问题的研究。对具体的评估指标体系进行深入研究的则更是少数。因此有必要进一步加强立法后评估指标体系的研究,加快评估指标体系的构建,以进一步完善我国的立法后评估制度。 本文通过对各个国家立法后评估标准的考察,总结出了适合我国的立法后评估模式。主要从法律法规本身的质量、法律法规的实施情况以及法律法规实施的效果三方面来设计指标,进行我国立法后评估指标体系的构建。指标设计出来以后还要对各个指标进行量化和综合统一,以便于对法律法规进行全面的分析,进而保证立法机关正确高效地对法律法规进行立、改、废,使立法与时俱进,切实可行。
[Abstract]:The traditional legislative theory attaches great importance to the study of the basic problems of legislation, such as legislative process, legislative competence, legislative technology and so on. Although these basic problems are indispensable factors in the study of legislative theory, they are of great significance to the improvement of legislative quality. But simply studying these problems can not solve and coordinate the contradictions and conflicts between laws and regulations of different departments in different periods. Whether the quality of laws and regulations is good in the final analysis depends on the application of laws and regulations and whether laws and regulations can withstand the test of practice to achieve the desired results. This requires the legislature to pay further attention to its implementation in the stage of the application of laws and regulations, and make sure that it can be modified if necessary to meet the needs of economic and social development. Therefore, it is imperative to carry out the post-legislative evaluation. The construction of the legislative post-evaluation index system is the core meaning of the post-legislative evaluation. In the post-legislative evaluation, the evaluation index acts as a wind vane. If the index system is scientific and reasonable, it can correctly reflect the effect and benefit of legislation and guide the benign development of legislative work. If the design of index system is not reasonable, it may mislead the choice of system and norm. It is very important to construct the evaluation index system in the post-legislative evaluation. The evaluation index system can provide scientific, objective scale and standard for the post-legislative evaluation. It is a powerful guarantee for the effectiveness of the evaluation and can guide the daily legislative work. Therefore, it is of great significance and value to strengthen the research on the index system of post-legislative evaluation. The post-legislative evaluation system has long been customized abroad. But the domestic research on the post-legislative evaluation system has just started. Although there have been many places to carry out the post-legislative evaluation in practice, but in the theoretical circle, scholars mainly focus on the definition of the concept of post-legislative evaluation. Analysis of the causes and significance of the post-legislative evaluation system, the way of post-legislative evaluation and other issues. The specific evaluation index system is a small number of in-depth research. Therefore, it is necessary to further strengthen the research of the post-legislative evaluation index system and accelerate the construction of the evaluation index system in order to further improve our country's post-legislative evaluation system. Based on the investigation of the standards of post-legislative evaluation in various countries, this paper summarizes the model of post-legislative evaluation suitable for our country. The index is designed from three aspects: the quality of the laws and regulations themselves, the implementation of laws and regulations and the effect of the implementation of laws and regulations, and the construction of the evaluation index system after legislation is carried out in our country. After the design of the indicators, it is necessary to quantify and unify the various indicators in order to facilitate the comprehensive analysis of laws and regulations, thereby ensuring that the legislature can correctly and efficiently set up, reform and scrap laws and regulations, so that legislation can keep pace with the times.
