【摘要】：法学和文学作为两门独立的学科,区分不是绝对化的,都需要语言的诠释,都需要结合语境具体理解。“法学与文学”是发源于美国法学院的一场学术运动,并演变成为一个法学流派或者领域,近年来逐渐为国人所知晓。法学与文学之间有一个丰富但混乱的潜在关联,它们有一定的相似之处。对两门学科的比较研究可以实现知识增量,在一定程度上丰富了文学领域,扩展文学研究的视野。首先,法学与文学的价值追求存在差异。其次,法学与文学因为其价值追求的差异决定了其语言的差异,从学科和语言本身的功能来看,这种差异都是必然存在的。所以,我们在解读法学规则和文学文本时要充分重视语言的语境性特征,对于文学文本来说,这种解读方式尤其重要。它不仅有助于我们更好地把握文学与法学在价值取向上,所表现出来的差异性,更可以让我们在这种价值取向的差异性的基础上,进一步来理解文学与法学在语言选择上的差异性,即便是表达类似或相同的主题。也只有在这样的基础上,我们才可以更好地理解语言的语境性内涵。
[Abstract]:As two independent disciplines, the distinction between law and literature is not absolute, it needs the interpretation of language and the concrete understanding of context. "Law and Literature" is an academic movement originated from American Law School, and has evolved into a school or field of law, which is gradually known by the people of China in recent years. There is a rich but confusing potential connection between law and literature, and they have some similarities. The comparative study of the two disciplines can realize the knowledge increment, enrich the literature field to a certain extent, and expand the field of view of literature research. First, there are differences in the pursuit of value between law and literature. Secondly, the difference of language between law and literature is determined by the difference of their value pursuit, which is inevitable from the function of discipline and language itself. Therefore, we should attach great importance to the contextual characteristics of language when interpreting legal rules and literary texts, which is especially important for literary texts. It not only helps us better grasp the differences in the value orientation between literature and law, but also enables us to base ourselves on the difference of this value orientation. To further understand the differences between literature and law in language choice, even if they express similar or the same subject. Only on this basis can we better understand the contextual connotation of language.
