【摘要】：依法治国,建立社会主义法治国家和构建和谐社会的基础是科学立法、高效执法、公正司法和自觉守法,而这一切的前提是公民具有良好的法律素质。良好的法律素质的核心是法律意识,公民只有具备了法律意识,才能自觉运用、遵守和维护法律。但是,由于我国传统上人治观念根深蒂固,所以作为思想意识领域的人的观念的改变并非一蹴而就,更非一朝一夕所能提高,它需要一个长期的,渐进的过程。因此,公民的法律意识的培养就是建设法治国家的重要课题。本文首先对法律意识进行理论研究。在这一部分,从法律意识这个概念的原始定义及其起源着手,分析了不同学者对这一概念的认识,得到了法律意识的定义和结构,并对其功能进行了一定的论述。在此基础上,研究了公民法律意识的核心内容,即公民法律意识的“四元”构成模式,这为培养机制的研究奠定了理论基础。其次,针对我国国情的特殊性,采用调查分析的方法,得到我国现阶段公民法律意识的现状,并结合我国的历史条件和现在的国情,对该现状进行系统科学的分析,进而得到我国公民在法律意识上的基本矛盾,这使得对公民法律意识培养机制的研究有一定的现实基础,能够有的放矢。最后,对公民法律意识的培养机制进行研究。将公民法律意识的培养机制从公民法律意识的动力机制和公民法律意识的培养机制两个角度进行分析。对于动力机制,重点从完善市场经济制度和社会主义民主制度两方面进行研究;对于实现机制,研究了民主的立法环境,公正的司法环境,依法行政,做好普法教育等方面的内容,并提出建立和普及符合法律价值的法律仪式等概念。总之,本文从分析公民法律意识的概念入手,探讨公民法律意识的核心内容和现阶段公民法律培养过程中面临的问题与挑战,在此基础上提出改进公民法律意识培养机制的对策性建议,希望借此为公民法律意识的培养提供一些指导。
[Abstract]:The foundation of governing the country according to law, building a socialist country ruled by law and building a harmonious society is scientific legislation, efficient law enforcement, fair administration of justice and conscious law-abiding, all of which presupposes that citizens have good legal quality. The core of good legal quality is legal consciousness. However, because the concept of rule by man is deeply rooted in the tradition of our country, the change of the concept of human being in the field of ideology is not accomplished overnight, nor can it be improved overnight. It needs a long and gradual process. Therefore, the cultivation of citizen's legal consciousness is an important subject for building a country ruled by law. This article first carries on the theory research to the legal consciousness. In this part, starting from the original definition and origin of the concept of legal consciousness, this paper analyzes the different scholars' understanding of the concept, obtains the definition and structure of legal consciousness, and discusses its function to a certain extent. On this basis, the paper studies the core content of citizen's legal consciousness, that is, the "four-element" composing mode of citizen's legal consciousness, which lays a theoretical foundation for the research of training mechanism. Secondly, according to the particularity of our country's national conditions, we adopt the method of investigation and analysis to get the present situation of citizen's legal consciousness in our country at present, and combine our country's historical condition and present situation, carry on the systematic scientific analysis to this present situation. Then we get the basic contradiction in the legal consciousness of Chinese citizens, which makes the research on the cultivation mechanism of citizen's legal consciousness have a certain realistic foundation and can be targeted. Finally, the cultivation mechanism of citizen's legal consciousness is studied. This paper analyzes the cultivation mechanism of citizen's legal consciousness from two angles: the motive mechanism of citizen's legal consciousness and the cultivating mechanism of citizen's legal consciousness. For the motive mechanism, the emphasis is on perfecting the market economy system and the socialist democratic system. For the realization mechanism, we have studied the democratic legislative environment, the just judicial environment, and the administration of administration according to law. It also puts forward the concept of establishing and popularizing the legal ceremony which accords with the legal value. In a word, this paper begins with the analysis of the concept of citizen's legal consciousness, and discusses the core content of citizen's legal consciousness and the problems and challenges in the process of citizen's legal cultivation at the present stage. On this basis, the author puts forward some suggestions to improve the cultivation mechanism of citizen's legal consciousness, hoping to provide some guidance for the cultivation of citizen's legal consciousness.
