【摘要】： 翻译转换是商务合同翻译中频频使用的一个常见手法。但是,学术界几乎没有对商务合同翻译中的转换现象进行过分析。因此,本文试图对中英文商务合同翻译中的翻译转换现象进行分析,并探究发生翻译转换的深层原因,并提出对法律文本翻译中出现的翻译转换进行评价的标准。为了达到这一目的,本文提出了三个研究问题:1)中英文商务合同翻译中适用的翻译转换种类;2)中英文商务合同翻译中适用翻译转换的原因;3)评价中英文商务合同翻译中翻译转换使用的标准。在本文中,翻译转换被定义为在译文中所有有异于原文的表达方式。本文将从微观和宏观两个层面分析翻译转换。在微观层面,翻译转换分为层次转换、单位转换、词性转换、结构转换和系统转换。在宏观层面,翻译转换分为修辞转换和文体转换。基于对中英文商务合同翻译中适用翻译转换的原因的分析,本文提出两个评价翻译转换使用的标准。为了分析中英文商务合同翻译中出现的翻译转换,本文从四个合同中选取了众多范例。并且在分析范例的过程中采用了Munday所设计的分析模式。笔者希望本文构建的研究框架能够有助于指导商务合同翻译的实际操作和质量评价。
[Abstract]:Translation conversion is a common technique frequently used in business contract translation. However, the academic circles have hardly analyzed the translation phenomenon in the translation of business contracts. Therefore, this paper attempts to analyze the phenomenon of translation conversion in the translation of Chinese and English business contracts, explore the underlying causes of translation conversion, and put forward the criteria for the evaluation of translation conversion in legal texts. To this end, This paper puts forward three research questions: 1) the types of translation conversion used in the translation of business contracts in English and Chinese 2) the reasons for the application of translation in translation of business contracts in English and Chinese, and 3) the criteria for evaluating the use of translation in the translation of business contracts in English and Chinese. In this paper, translation transformation is defined as all expressions in the translation that are different from the original text. This paper will analyze the translation transformation from the micro and macro levels. At the micro level, translation transformation is divided into hierarchical transformation, unit transformation, part of speech conversion, structural transformation and systematic transformation. At the macro level, translation transformation is divided into rhetorical transformation and stylistic transformation. Based on the analysis of the reasons for the application of translation conversion in the translation of Chinese and English business contracts, this paper proposes two criteria for evaluating the use of translation conversion. In order to analyze the translation transformation in the translation of Chinese and English business contracts, this paper selects many examples from four contracts. And the analysis model designed by Munday is adopted in the process of analyzing the example. The author hopes that the research framework constructed in this paper will be helpful to guide the practical operation and quality evaluation of business contract translation.
