政府普法的沟通效果研究

【摘要】: 普法是由政府主导的普及法律常识实践活动,已经进行了二十多年,它是中外法制史上的创举,也是政府沟通的通道。目前,普法工作已经形成了较为完善的政府沟通组织实施体系,政府沟通的议题供给充足,沟通需求不断呈现,而且沟通形式丰富多样。但在政府普法沟通过程中也存在着连续性不佳、互动性不足、针对性不强、科学性不够等问题。其政治路径造成了自上而下的沟通模式,需要不断强化政治沟通动力;主要使用的动员型沟通、传播型沟通和互通型等三种沟通形式,部分形式还需要发展成熟;其合法性制度初步建立,协调性制度基本具备,执行性制度还需调整,这些构成了普法政府沟通效果不佳的复合因素。同时,沟通执行过程中的活动数量、持续时间、沟通范围、沟通目标以及沟通情境中的人员素质、形式选择、议题选择以及制度执行不力等沟通效率因素也会影响普法政府沟通整体效果。据此,应通过立法手段根据法治原则、沟通规律、法治特性来构建普法制度保持连续性,通过强化议题发动形成自下而上的沟通趋势增强互动性,通过调配资源探索丰富普法形式加强针对性,建立绩效体系监控普法效果提升科学性,从而进一步推进普法工作。
[Abstract]:The popularization of law is a practice of popularizing common sense of law led by the government, which has been carried on for more than 20 years. It is a pioneering undertaking in the history of Chinese and foreign legal system, and also a channel of communication between the government and the Chinese government. At present, the work of legal popularization has formed a relatively perfect implementation system of government communication organizations. The issues of government communication are adequate, the communication needs are constantly presented, and the forms of communication are rich and diverse. However, in the process of communication between government and law, there are some problems, such as poor continuity, insufficient interaction, weak pertinence and insufficient science. The political path leads to the top-down communication mode, which needs to strengthen the power of political communication, the three main forms of communication, such as mobilization communication, communication and communication, some of which need to be developed and mature. The legality system is initially established, the coordination system is basically possessed, and the executive system still needs to be adjusted, which constitute the complex factors of the poor communication effect of the government. At the same time, the number of activities, duration, communication scope, communication goals, personnel quality and form selection in communication implementation process, Such communication efficiency factors as topic selection and weak system implementation will also affect the overall effectiveness of government communication. Therefore, it is necessary to construct the legal popularization system by means of legislation, according to the principle of rule of law, the law of communication and the characteristics of the rule of law, to maintain continuity, and to enhance the interaction of the bottom-up communication trend through the strengthening of topic initiation. Through the allocation of resources to explore rich legal forms to strengthen the pertinence, to establish a performance system to monitor the effectiveness of law popularization to enhance the scientific nature, so as to further promote the work of law popularization.
