法律体系理论与当代中国法律体系的建构——以法律体系理论的有用与无用为分析起点

【摘要】：目前我国学界存在关于法律体系理论有用和无用的争论。此次争论是一个人为制造且较为混乱的争论,但是却揭示了我国法律体系建构中出现的问题——缺少理论。根据实践与理论之间关系的内在规定性,当代中国的法律体系构建应当有法律体系理论的参与。我国法律体系建构中缺少理论的原因在于对实践与理论之间关系的错误认识——惟实践主义倾向。
[Abstract]:At present, there are arguments about the usefulness and uselessness of the theory of legal system in Chinese academic circles. The controversy is a man-made and chaotic one, but it reveals the problem in the construction of our legal system-the lack of theory. According to the inherent regulation of the relationship between practice and theory, the construction of legal system in contemporary China should involve the theory of legal system. The reason for the lack of theory in the construction of our legal system lies in the wrong understanding of the relationship between practice and theory-but the tendency of pragmatism.
