领导者人治偏好的现实基础与防治思路

【摘要】：正十八大报告指出,"要提高领导干部运用法治思维和法治方法深化改革、推动发展、化解矛盾、维护稳定能力",再次强调了执政党要依法执政,政府要依法行政,领导干部在工作中也要依法办事。不可否认,经过近几十年的实践探索,我国社会法治化进程明显加快,依法治国、依法办事已经成为普遍共识,各级领导干部法律素养不断增强,依法决策、依法行政水平有了很大提升。但是,人治思维和人治方式还颇受一些领导干部的青睐,以言代法、以权压法、徇私枉法的现象并不鲜见。一、领导者人治偏好的现实基础分析尽管党的十五大已经将"依法治国,建设社会主义法治国家"确立
