论法制促进祖国和平统一进程的作用

【摘要】：解决台湾问题、实现祖国完全统一,是全体中华儿女的共同心愿。主权统一是国家统一的法律基础。从历史上看大陆和台湾同属一个中国,后来由于多种原因台湾与大陆隔绝,尽管两岸尚未统一,但大陆和台湾同属一个中国的事实从未改变。台湾是中国不可分割的一部分,必须通过历史的考察,首先弄清台湾问题的来龙去脉。在一个中国的原则基础上解决台湾问题,需要全中国人民的共同努力,需要构建各种方法、手段和机制。其中发挥法律的作用促进两岸统一,不失为构建两岸关系和平发展框架的一种良好选择。要进一步厘清两岸法制冲突与共识。要继续遵循“和平统一、一国两制”的方针。香港、澳门回归祖国以来,“一国两制”实践日益丰富。“一国两制”是完全正确的,具有强大生命力。按照“一国两制”实现祖国和平统一,符合中华民族根本利益。从“和平统一、一国两制”的方针制定的源头考察,重新审视这一方针的创新之处,弄清这一方针的法理基础,并阐明落实“一国两制”战略的法治实践。要探索国家统一进程的法制化。首先弄清和平统一的法律基石,进而构建两岸互动的法制平台,同时保持遏制“台独”的法制力量。两岸同胞要共同反对和遏制“台独”分裂活动。中国主权和领土完整不容分割。我们决不承诺放弃使用武力,不是针对台湾同胞的,而是针对外国势力干涉中国统一和台湾分裂势力搞“台湾独立”图谋的。维护祖国统一事关中华民族的根本利益,中国人民将义无反顾地捍卫国家主权和领土完整,绝不允许任何人以任何方式把台湾从中国分割出去。
[Abstract]:Resolving the Taiwan issue and realizing the complete reunification of the motherland is the common wish of all the Chinese people. The unification of sovereignty is the legal basis of national unity. Historically, the mainland and Taiwan both belong to one China, but the fact that the mainland and Taiwan belong to one China has never changed, because Taiwan and the mainland were isolated from the mainland for a variety of reasons, although the two sides of the strait have not yet been reunified. Taiwan is an inseparable part of China. To resolve the Taiwan issue on the basis of the one-China principle requires the joint efforts of the entire Chinese people and the construction of various methods, means and mechanisms. Giving full play to the role of law to promote the reunification of the two sides of the strait is a good choice for building a framework for the peaceful development of cross-strait relations. It is necessary to further clarify the conflict and consensus between the two sides of the strait. We should continue to follow the principle of "peaceful reunification and one country, two systems." Since the return of Hong Kong and Macao to the motherland, the practice of "one country, two systems" has become increasingly rich. The principle of "one country, two systems" is completely correct and has great vitality. The peaceful reunification of the motherland in accordance with the principle of "one country, two systems" conforms to the fundamental interests of the Chinese nation. From the source of the formulation of the policy of "peaceful reunification and one country, two systems", this paper re-examines the innovation of this policy, clarifies the legal basis of this policy, and expounds the practice of the rule of law in implementing the strategy of "one country, two systems". We should explore the legalization of the process of national unification. First of all, we should make clear the legal cornerstone of peaceful reunification, and then construct a legal platform for cross-strait interaction, and at the same time maintain the legal power to contain "Taiwan independence." Compatriots on both sides of the strait should jointly oppose and curb separatist activities of "Taiwan independence." China's sovereignty and territorial integrity cannot be separated. We will never commit ourselves to renouncing the use of force, not against our compatriots in Taiwan, but against the attempt of foreign forces to interfere in China's reunification and the separatist forces in Taiwan to pursue "Taiwan independence." Safeguarding the reunification of the motherland is vital to the fundamental interests of the Chinese nation, and the Chinese people will defend the sovereignty and territorial integrity of the country without hesitation, and will never allow anyone to separate Taiwan from China in any way.
