法学案例教学模式的探索与创新

【摘要】:正作为一门与司法实践紧密联系的学科,法学与其他人文学科有较大的区别。法学教育不仅要传授法学知识,而且还要担负起培养掌握各类法律技能,胜任实际法律工作的"法律人"的重任。由此观之,"实践性"、"应用性"成为当前大陆法学教育的一个导向,可谓是顺应了法学教育的内在规律。为了培养法科学生的法律实务能力,就需要强化法学院的实践性教学。法学实践性教学的内容广泛,并且处于不断的发展、变化当中;不过,案例教学在其中始终居于某种关键地位。纵观当今世界,影响较大的案例教学模式主要是以美国为代表的"个案教学法"、以德国为代表的"实例研习",以及起源
[Abstract]:As a subject closely related to judicial practice, law is different from other humanities. Legal education should not only impart legal knowledge, but also take on the important task of cultivating "legal person" who can master all kinds of legal skills and be competent in practical legal work. From this point of view, "practicality" and "application" have become a guide of current law education in mainland China, which can be said to conform to the inherent law of law education. In order to cultivate the legal practice ability of law science students, it is necessary to strengthen the practical teaching in law school. The content of practical teaching of law is extensive, and it is constantly developing and changing; however, case teaching has always played a key role in it. Throughout the world, the most influential case teaching models are mainly the case teaching method represented by the United States, the case study represented by Germany, and the origin of the case teaching method.
