论法律对媒体监督权的规范

【摘要】： 在我国,随着法治建设的不断推进,媒体舆论监督的作用受到越来越多的关注。但媒体监督权是一柄双刃剑,任何一种权力(利)都有滥用的可能性。因此,在保障媒体监督权有效行使的同时,必须加强和完善对媒体监督权的法律规范。本课题的研究对于规范媒体监督权的行使,使其发挥正面作用有着重要的理论价值和现实意义。从理论上来说,大多数学者谈及媒体监督都是将其作为一种制度,作为舆论监督的一部分,很少从权力(利)角度对其进行正面的研究,因此,在学术上,对媒体监督权并没有一个确切的、权威的定义。本文从媒体监督权的属性出发对其进行界定,从而得出一个相对全面的概念。另外,本文从法理与现实意义两个层面探究法律规范媒体监督权行使的必要性,并且立足理论与实务,对法律规范媒体监督权行使的路径进行构建。本文综合运用价值分析法、文献研究法、历史研究法、比较研究法以及案例研究法。通过这些研究方法的运用,本文得出了对媒体监督权的行使进行规范的现实意义;得出法律对媒体监督权的行使进行规范的应然状态,确定了规范的限度问题;得出了法律规范媒体监督权行使的具体途径和方法。
[Abstract]:In our country, with the development of the rule of law, more and more attention has been paid to the role of media supervision. But the power of media supervision is a double-edged sword, any kind of power has the possibility of abuse. Therefore, while ensuring the effective exercise of media supervision, we must strengthen and perfect the legal norms of media supervision. The research of this subject has important theoretical value and practical significance for standardizing the exercise of media supervision power and making it play a positive role. In theory, most scholars talk about media supervision as a system, as a part of public opinion supervision, and rarely do positive research on it from the perspective of power (profit), therefore, in the academic, There is no definitive, authoritative definition of media supervision. This paper defines the media supervision power from its attributes, and draws a relatively comprehensive concept. In addition, this paper probes into the necessity of the exercise of media supervision by law from two aspects of legal theory and practical significance, and based on theory and practice, constructs the path of exercising media supervision. This paper uses value analysis method, literature research method, historical research method, comparative research method and case study method. Through the application of these research methods, this paper obtains the practical significance of standardizing the exercise of the media supervision power, and concludes that the law should regulate the exercise of the media supervision power and determine the limitation of the norms. The specific ways and methods of regulating the exercise of media supervision power by law are obtained.
