20世纪20年代湖南省宪运动中的选举风潮

【摘要】： 20世纪初期,北洋政府统治之下的中国,地方军阀割据,形成南北政府对峙的局面,此时联省自治呼声高涨。各省纷纷宣布独立并着手制定省宪。省宪多多是以追求民主社会为目标,省内自主权力很高,较大程度上了保障了公民权利并限制政府权力联省自治运动中,各省多以制定省宪为第一步,其中已公布的省宪和宪法草案中,《湖南省宪法》是第一个制定并且唯一正式施行的宪法。本文以湖南省宪法为基础,论述湖南省宪法实施中的第一步——全民选举。这是成立省宪颁布以后,湖南自治重要的一步。 本文主要有由五部分组成: 第一部分是导言,主要交代本文的选题背景和目的。对湖南省宪法和省宪运动中的直接选举分别作出评论,选择以选举风潮为题写作论文。 第二部分关于湖南省宪与选举制度。主要论述湖南省宪的制定过程和选举的法律依据。从选举的主要依据——《湖南省宪法》出发,论述湖南自治和省宪制定的过程,以及省宪公布后社会各界的反应。结合省宪和相关法律和政府规定,介绍省政府为选举所做的准备工作。 第三部分是关于选举风潮。主要论述在选举过程中出现的选民、竞选人和选举事件,从法律实施的角度出发,研究湖南省宪运动中的选举。结合直接资料的记载,分析选举的特点。重点论述选举过程中社会各界积极参与的情形、新政府的成立等过程。 第四部分是关于选举的评价。主要记述从当时到现代,社会各界对选举制度、选举运动、新议员期望等的观点,总结当时社会对湖南选举作出的最直接的讨论。在前人分析的基础上,结合此次选举的自救性质和直接选举的意义所在,对选举作出评论。 最后一部分是结语。主要结合省宪与选举制度的民主性和革命性,涉及直接选举制度建设的民主性和合理性讨论。
[Abstract]:In the early 20th century, under the rule of Beiyang government in China, local warlords separated, forming a situation of confrontation between North and South governments. The provinces declared their independence and set out to formulate the provincial constitution. The aim of the provincial constitutionalism is to pursue a democratic society, and the power of autonomy in the province is very high. To a large extent, it has guaranteed the rights of citizens and restricted the power of the government. In the movement, most provinces took the formulation of the provincial constitution as the first step. Among the published provincial constitutions and the draft of the constitution, the Constitution of Hunan Province is the first and only one formally implemented. Based on the Constitution of Hunan Province, this paper discusses the first step in the implementation of the Constitution of Hunan Province-National elections. This is the establishment of the provincial constitution after the promulgation of Hunan autonomy an important step. This paper consists of five parts: the first part is the introduction, which explains the background and purpose of this paper. This paper makes a comment on the direct election in the constitution of Hunan province and the movement of the constitution of the province, and chooses the election trend as the topic of writing the thesis. The second part is about the constitution and election system of Hunan Province. This paper mainly discusses the process of constitution making and the legal basis of election in Hunan Province. Starting from the main basis of election, the Constitution of Hunan Province, this paper discusses the process of Hunan autonomy and the formulation of provincial constitution, as well as the reaction of all walks of life after the publication of the provincial constitution. Combined with the provincial constitution, relevant laws and government regulations, the provincial government preparations for the election. The third part is about the election storm. This paper mainly discusses the voters, candidates and events in the election process, and studies the election in the constitutional movement of Hunan Province from the point of view of the enforcement of the law. The characteristics of the election are analyzed in combination with the records of direct data. The paper focuses on the process of the active participation of all sectors in the election process and the establishment of the new government. The fourth part is about the election evaluation. From that time to the modern, this paper mainly describes the social views on the electoral system, the election movement and the expectation of the new legislators, and summarizes the most direct discussion of the Hunan election at that time. On the basis of previous analysis, this paper makes comments on the election by combining its self-saving nature and the significance of direct election. The last part is the conclusion. Combining with the democracy and revolution of provincial constitution and electoral system, the paper discusses the democracy and rationality of the construction of direct election system.
