软法国内化的演变及其存在的问题——对“软法亦法”观点的商榷

【摘要】：通过对软法国内化演变的追溯可以发现,软法理论的特点在于强调软法的实效性。软法论者以能否运用国家强制力保障实施这一标准将扩展后的法范畴划分为软法和硬法,其实质是从保证法实效实现的要素角度对法进行的一种新的划分。但这种划分造成了保证法实效实现中的二要素——认同与强制的机械分离,特别是在软法的触角从社会法领域延伸至国家法并导致国家法领域"一分为二"之后,更引发了软法理论与既有的国家法理论之间的冲突。在目前我国法治环境质量不够好的情况下,不适当地提倡软法对我国法治进步容易产生始料未及的负面影响。如何真正推进法治,包括真正实现"软法之治",是目前软法研究首先绕不过去的重要问题。
[Abstract]:By tracing the evolution of soft French internalization, we can find that the characteristic of soft law theory lies in emphasizing the effectiveness of soft law. The soft law theorists divide the expanded category of law into soft law and hard law by the criterion of whether to use the national coercive force to ensure the implementation of the law. Its essence is a new division of the law from the angle of the essential factors of the realization of the actual effect of the guarantee law. However, this division results in the mechanical separation of identity and compulsion in the realization of the effectiveness of the law, especially after the tentacles of soft law extend from the field of social law to the national law and lead to the division of the field of national law into two. It also leads to the conflict between soft law theory and existing state law theory. Under the condition that the quality of our country's legal environment is not good enough, it is easy to have unexpected negative effects on the progress of our country's rule of law by advocating soft law inappropriately. How to really promote the rule of law, including the realization of "soft law governance", is the first important problem that soft law research can not go around.
