行省制度的确立对罗马法的影响——以西西里行省的设立为中心

【摘要】：第一次布匿战争后,罗马人占领了西西里,并首次采用行省的形式加以治理,从而区别于意大利本土的同盟制。此后,随着罗马帝国的扩张,行省的数目逐渐提高到53个之多。因而,行省的治理问题成为罗马帝国的头等大事。为此,罗马人采取了分类而治、设立行省议会、向行省移民、授予行省精英人士罗马市民权、建立统一的宗教等措施对行省进行治理。由此建立起来的行省制度对罗马公法和私法都产生了深远的影响,表现为:混合制宪法的终结、官员薪给制度的确立、新罪名和新型法院的产生、财税制度的转型、万民法的产生、意大利法与行省法二元制的形成,等等。
[Abstract]:After the first Punic War, the Romans captured Sicily and first administered it in the form of a province, distinguished from the Italian confederacy. Since then, with the expansion of the Roman Empire, the number of provinces gradually increased to 53. As a result, the governance of the province became the first priority of the Roman Empire. To this end, the Romans adopted the classification and governance, set up the provincial council, emigrated to the province, granted the province elite Roman city civil rights, established a unified religion and other measures to govern the province. The provincial system has a profound influence on the Roman public and private law, such as the end of the mixed constitution, the establishment of the official payroll system, the emergence of new charges and new courts, and the transformation of the fiscal and taxation system. The emergence of the law of the people, the formation of the dual system of Italian law and provincial law, and so on.
