论沈家本的良善刑法观

【摘要】：作为一个博古通今、学贯中西的晚清法学大家,沈家本认为"各法之中,尤以刑法为切要",刑法应当是良善之法,既要稳定、统一、明确,又要权时而变,保障人权及平等,并阐述了良善刑法的产生及实现条件,这些对于当今我国正在进行的刑事立法及司法改革仍具有十分重要的借鉴意义。
[Abstract]:As a scholar of the late Qing Law of China and the West, Shen Jiaben believed that "among all laws, criminal law is the most important." the criminal law should be a law of good and good. It should be stable, unified, clear, and change from time to time in order to safeguard human rights and equality. It also expounds the emergence and realization conditions of good criminal law, which is still of great significance for the criminal legislation and judicial reform in our country.
