中国古代法官责任制度研究

【摘要】： 中国古代法官责任制度,是中国古代封建行政管理制度的核心内容之一,是中国古代诉讼法律和行政法律的重中之重,它的确立和发展,反映了中国古代高度发达的社会文明和法制文明,是中国古代法制史的一大特色,也凸显了中国古代法文化的本质。本文以中国古代法官责任制度的历史演变、主要内容、基本特征和思想基础为研究对象。论文的主题是以中国古代法官责任制度为基点,借鉴中国古代法官责任制度之精华,更好地构建和完善现代社会司法官员的责任制度。本文拟从中国古代法官责任制度的历史演变、主要内容、基本特征、思想基础以及现实借鉴五个方面加以研究,力图做到观古察今,领略中国古代法官责任制度的基本风貌和精神,对于当今社会法官责任制度的完善提出有益的建议。
[Abstract]:The responsibility system of judges in ancient China is one of the core contents of feudal administrative management system in ancient China. It is the most important part of litigation law and administrative law in ancient China, and its establishment and development. It reflects the highly developed social civilization and legal civilization in ancient China, which is a major feature of the history of legal system in ancient China, and also highlights the essence of Chinese ancient legal culture. This paper focuses on the historical evolution, main contents, basic characteristics and ideological basis of the system of judges' responsibility in ancient China. The theme of this paper is to build and perfect the responsibility system of judicial officials in modern society on the basis of the system of judges' responsibility in ancient China and the essence of the system of judges' responsibility in ancient China. This paper intends to study the historical evolution, main contents, basic features, ideological basis and practical reference of the system of judges' responsibility in ancient China, in an attempt to look into the present and ancient times. In view of the basic style and spirit of the system of judges' responsibility in ancient China, some useful suggestions are put forward for the perfection of the system of the responsibility of judges in today's society.
