清代涉坟土地的类型及流转原因辨析

【摘要】：坟地在中国传统社会有着特殊的意义。清代法律十分注重对坟地的保护,并严格限制坟地和"红地"的流转。但在民间,涉坟土地的流转大量存在。相对于清律的规定,民间实践在涉坟土地的类型和流转原因方面采取的是"扩大主义",即涉坟土地的类型及流转原因都超越了清律限定的范围,其缘由或可归因于清代人口迅速膨胀所致的人地关系紧张等社会问题。
[Abstract]:Graveyard has special significance in Chinese traditional society. The law of Qing Dynasty paid great attention to the protection of graveyard and strictly restricted the circulation of graveyard and red land. However, in the folk, the circulation of graveyard land exists in large numbers. Compared with the provisions of the Qing law, the folk practice adopts the "expansionism" in the type and circulation reason of the graveyard land, that is, the type and circulation reason of the graveyard land go beyond the scope limited by the Qing law. The reason may be attributed to the social problems such as the tension between man and land caused by the rapid expansion of population in Qing Dynasty.
