论基督教圣约观对美国联邦主义宪政的影响

【摘要】: 圣约与其说是一个神学概念,不如说是一个政治哲学上的概念。它以一种独特的方式进入现代并逐步完善,政治的因素逐渐地掩盖了宗教的含义,最后以宪政的形式体现出来。圣约观源于希伯来圣经,是基督教中一种极其独特而又影响深远的宗教观念和思想。圣经中的“四重约”勾勒出从圣约到契约的世俗化过程。作为一种经典的传统思想,基督教圣约观在经历现代思想洗涤后并没有消失,而是以一种独特的方式融入现代,介入政治生活,表现出强大的生命力。圣约观与联邦主义宪政逻辑相容。个体平等、权利神圣、有限政府等宪政观念恰恰为基督教圣约观所涵括,从而赋予了这三个核心要素以神圣背景和道德基础。因此,基督教圣约观是联邦主义宪政的精神支柱和价值源泉之一。 基督教圣约观塑造了美国的宪政文明,指引着美国政治制度的构建。这种信仰层面的圣约观由清教徒们在两代人的时间内转化为实际运行的联邦主义宪政制度,为美国奇迹的诞生奠定了坚实的观念和制度根基。美国联邦主义宪政的发展是一个从圣约到宪约的过程。圣约先于宪法,宪法先于宪政。宪法中隐含着作为高级法的圣约思想,宪法一旦失去(神)圣约(法)的高级法背景,就缺失了神圣性。圣约思想为联邦主义宪政秩序的构建提供了具体的制度范式和抽象的观念支撑,不断推动宪政制度走向完善。
[Abstract]:The covenant is not so much a theological concept as a political philosophy. It entered the modern and gradually improved in a unique way, and the political factors gradually covered up the meaning of religion, and finally reflected it in the form of constitutional government. The view of covenant originates from the Hebrews Bible and is an extremely unique and far-reaching religious concept and thought in Christianity. The quadruple covenant in the Bible outlines the secularization process from the covenant to the contract. As a classical traditional thought, the Christian covenant view did not disappear after the washing of modern thought, but integrated into modern times in a unique way, intervened in political life and showed strong vitality. The view of covenant is compatible with the constitutional logic of federalism. The constitutional concepts of individual equality, sanctity of rights and limited government are precisely included in the Christian covenant view, thus giving these three core elements a sacred background and a moral foundation. Therefore, the Christian covenant view is one of the spiritual pillars and value sources of federalism. The Christian covenant view shapes the constitutional civilization of the United States and guides the construction of the American political system. This view of covenant at the level of belief was transformed from Puritans into a federalist constitutional system in two generations, which laid a solid conceptual and institutional foundation for the birth of the American miracle. The development of federalism in the United States is a process from Covenant to Constitutionalism. The covenant precedes the constitution and the constitution precedes the constitution. The constitution implies the covenant thought as the higher law. Once the constitution loses the higher legal background of the covenant (law), it lacks the sanctity. The thought of covenant provides a concrete institutional paradigm and abstract concept support for the construction of federalist constitutional order, and constantly promotes the perfection of constitutional system.
