中英法律语言模糊性现象的对比研究

法律语言学是一门新兴学科,是研究法律和语言关系的一种专门用途语言学。法律或者法是由政府或者其它权利机构制定或认可的准则、规定、规则等。它通过规定人们的权利和义务来确认、保护和发展社会关系和社会秩序。它与人们的生活息息相关。 语言是交际的桥梁,法律是通过语言来订立和公布的。因此作为法律的语言必须精确、严谨,然而模糊是语言的固有属性,法律语言也不能避免模糊现象。因此大量的模糊语言存在于法律语言中,对法律语言有着不容忽视的影响。前人就法律英语中的模糊现象进行了大量研究,但很少涉及法律汉语。因此本文在介绍法律语言学的基础上,分别从语义学和语用学角度对比研究中英法律语言的模糊性现象及其成因,提高英语学习者和法律语言研究者对中英法律语言模糊性现象的理解。
