英文法律文本中复杂长句的汉译

随着中国加入WTO,对外经贸往来不可避免地日益增多,各种相关的法律文件也发挥着越来越重要的作用。由于英语是世界通用的语言,英文法律文件也成为全球使用范围最广、使用频率最高的法律文件。与此同时,中国作为世界一极,地位不断上升,中文法律文件也日趋重要。鉴于中外语言、文化及法律体系方面的差异客观存在,为便于法律文件的各有关方能够进行准确、有效的理解与沟通,对法律文件进行翻译的必要性和重要性日渐凸显。然而,国内对于汉外法律文件互译（包括英汉互译）规律性的认识和研究尚存在着一定差距。同时,由于汉、英两种语言本身就有较大差异,中国作为大陆法系国家与英美法系国家在文化和法律体系方面的差异也非常显著,所有这些因素使得英文法律文件的汉译成为难度最大的翻译种类之一;其中的复杂长句更成为影响译文质量的瓶颈。本文从以上客观现实和需要出发,结合作者自身的从业经验,详细分析了英文法律文本和其中复杂长句的特点,列举了汉、英两种语言之间的差异,论证了翻译时应采取的策略,即宏观上采取异化翻译策略,适当辅之以归化翻译;并进而提出了相应的翻译方法,以期对法律文本翻译的研究和实践有所裨益。本文共分六章。作为引论,第一章介绍了...
