我国农业循环经济法制建设存在的问题及解决路径研究

【摘要】：随着循环经济理念的产生和广泛传播,世界大多数国家也大力支持循环经济在本国各行业领域的发展,自发展循环经济的理念传入我国以来,在工业、旅游业等领域得到了不同程度的重视和发展,我国政府高度重视和有效促进循环经济发展,制定实施《循环经济法》,以法律条文的形式展现和规制循环经济的理念和要求,虽然循环经济在我国各个领域均有所涉及,但相比较而言,仅在工业领域发展势头良好,尤其是在农业发展的领域,循环经济基本处于刚刚起步的阶段,我国一直是传统的农业大国,传统的农业生产者为了追求高效率的农业生产活动,不惜以破坏生态环境、浪费农业资源作为代价以增加农业产值,农业的发展关系到国计民生,然而,随着农业生态环境被逐步破坏,农业资源的日益短缺,循环经济理念的广泛传播,以及生态学、经济学理论的日益丰富,农业生产者逐步产生了发展循环经济的意识,发展农业循环经济,需要健全的农业循环经济法制为其保驾护航。本文立足于我国农业循环经济的发展现状,剖析了农业法制的建设存在的问题,总结了国外发展农业循环经济的经验,并结合我国当前循环型农业发展的情况和法制建设的状况,提出了解决我国农业循环经济法制中存在问题的路径。第一部分主要是阐述了农业循环经济的内涵、特征等基础性理论,分析了我国健全农业循环经济法制的可行性和紧迫性。第二部分主要是对国内外农业循环经济法制的建设状况进行阐述。首先,对美国、德国、法国、西班牙和日本农业循环经济法制建设的状况进行了分析阐明；其次,从农业立法现状和农业普法现状两个方面对我国的农业循环经济法制建设状况进行了列举和阐明。第三部分主要是对当前我国农业循环经济法制建设的现状进行了分析,从立法、法制宣传、执法监督三个方面着手,分析了当前我国农业循环经济法制建设的现状及存在的问题。第四部分是本文的重点所在,立足于前三章的分析研究,提出了解决当前我国农业循环经济法制建设问题的路径选择。立足于当前我国的实际国情,借鉴国外农业循环经济法制建设的成功经验,提出要健全我国农业循环经济法制,就应当不断完善农业循环经济法律体系、守法机制和执法监督机制。
[Abstract]:With the emergence and wide dissemination of the concept of circular economy, most countries in the world also strongly support the development of circular economy in various fields of their own industries, since the concept of circular economy was introduced into our country, in industry. Tourism and other fields have received different degrees of attention and development. Our government attaches great importance to and effectively promotes the development of circular economy, and formulates and implements the Circular economy Law. In the form of legal provisions to show and regulate the concept and requirements of circular economy, although circular economy in all fields of our country are involved, but in comparison, only in the industrial field has a good momentum of development. Especially in the field of agricultural development, circular economy is just in its infancy. China has been a traditional agricultural country, traditional agricultural producers in order to pursue high efficiency of agricultural production activities. At the cost of destroying ecological environment and wasting agricultural resources to increase agricultural output value, the development of agriculture is related to the national economy and people's livelihood. However, with the gradual destruction of agricultural ecological environment, agricultural resources are increasingly short. With the widespread dissemination of the concept of circular economy and the increasing enrichment of ecological and economic theories, agricultural producers have gradually developed the consciousness of developing circular economy and developing agricultural circular economy. Need sound agricultural circular economy legal system for its escort. Based on the current situation of agricultural circular economy in China, this paper analyzes the problems existing in the construction of agricultural legal system and summarizes the experience of foreign countries in developing agricultural circular economy. Combined with the current situation of the development of circular agriculture and the construction of the legal system in our country, the paper puts forward the way to solve the problems existing in the legal system of agricultural circular economy in our country. The first part mainly expounds the connotation, characteristics and other basic theories of agricultural circular economy. This paper analyzes the feasibility and urgency of perfecting the agricultural circular economy legal system in China. The second part mainly expounds the construction of the agricultural circular economy legal system at home and abroad. First of all, the United States, Germany, France. The situation of legal system construction of agricultural circular economy in Spain and Japan is analyzed and clarified. Second. This paper enumerates and clarifies the legal construction of agricultural circular economy in China from two aspects: the current situation of agricultural legislation and the present situation of agricultural law popularization. The third part is mainly about the current situation of the legal construction of agricultural circular economy in China. The analysis. From the three aspects of legislation, legal publicity, law enforcement supervision, this paper analyzes the current situation and existing problems of the legal construction of agricultural circular economy in China. Part 4th is the focus of this paper. Based on the analysis and research in the first three chapters, this paper puts forward the path choice to solve the problem of the legal system construction of agricultural circular economy in our country at present, which is based on the actual situation of our country. This paper draws lessons from the successful experience of foreign countries in the construction of agricultural circular economy legal system, and points out that in order to perfect our country's agricultural circular economy legal system, we should constantly perfect the agricultural circular economy legal system, law-abiding mechanism and law enforcement supervision mechanism.
