中外环境影响评价法律制度比较研究

【摘要】： 环境影响评价法律制度自20世纪60年代在环境保护领域形成以来,许多国家都建立了环境影响评价法律制度,环境法中的环境影响评价法律制度在世界各国和国际社会得到了普遍推行。在我国的环境保护中,强调环境影响评价法律制度具有极为重要的意义。我国是社会主义国家,人民是国家的主人,广大公民对于维持与自身生存休戚相关的环境品质的改善有着当然的权利。在环境法中确立环境影响评价法律制度,是人民民主理念在环境法中的体现。我国的环境影响评价法律制度尚未完善,在理论研究的基础上,推动我国环境影响评价法律制度不断完善与发展是我国环境保护领域的一项紧迫任务。当然,这需要借鉴国外环境影响评价法律制度的先进经验,又要紧密结合我国的国情。本文针对完善和发展我国环境影响评价法律制度这一核心问题进行了系统的研究,共分为六个部分。第一部分,环境影响评价法律制度的基本概念与基本理论;第二部分,国外环境影响评价法律制度的现状及研究,共对美、日、德三个国家进行了研究;第三部分,我国环境影响评价法律制度的现状及研究;第四部分,对国内外的环境影响评价法律制度进行比较;第五部分,承接上一部分,指出我国环境影响评价法律制度存在的不足;最后,为了完善我国的环境影响评价法律制度,在借鉴发达国家经验的基础上,本文提出如下途径:一是拓宽环境影响评价法律制度的适用范围;二是规定环评报告书中必须有替代方案;三是建立完善的监管体制;四是增强公众参与相关规定的可操作性。
[Abstract]:Since the legal system of environmental impact assessment was formed in the field of environmental protection in 1960s, many countries have established the legal system of environmental impact assessment. The legal system of environmental impact assessment in environmental law has been widely implemented in the world and the international community. In the environmental protection of our country, it is of great significance to emphasize the legal system of environmental impact assessment. China is a socialist country, and the people are the masters of the country. The majority of citizens have the right of course to maintain the improvement of environmental quality which is closely related to their own survival. The establishment of the legal system of environmental impact assessment in environmental law is the embodiment of the people's democratic concept in environmental law. The legal system of environmental impact assessment in China is not yet perfect. On the basis of theoretical research, it is an urgent task in the field of environmental protection to promote the continuous improvement and development of the legal system of environmental impact assessment in China. It is necessary to draw lessons from the advanced experience of foreign environmental impact assessment legal system, and closely combine the national conditions of our country. This article has carried on the systematic research to the core question of perfecting and developing the legal system of environmental impact assessment in our country, which is divided into six parts: the first part, the basic concept and theory of the legal system of environmental impact assessment; the second part, The current situation and research on the legal system of environmental impact assessment in foreign countries, including the United States, Japan and Germany; part III, the current situation and research of the legal system of environmental impact assessment in China; part 4th, Comparing the legal system of environmental impact assessment at home and abroad; part 5th, following the previous part, pointing out the shortcomings of the legal system of environmental impact assessment in China; finally, in order to improve the legal system of environmental impact assessment in China, Based on the experience of developed countries, this paper proposes the following ways: first, to broaden the scope of application of the environmental impact assessment legal system; second, to stipulate that there must be alternative schemes in the EIA report; third, to establish a sound regulatory system; Fourth, to enhance public participation in the relevant provisions of the operability.
