【摘要】： 现代和谐社会,由环境问题引发的众多环境纠纷迫切需要建立一套高效健全的环境纠纷解决机制,这其中环境行政裁决正是适应现代社会发展而产生的解决环境纠纷的新模式。与诉讼相比,环境行政裁决具有程序简便、费用低廉以及有利于解决专业性、技术性较强的环境纠纷等优点,并且作为一种诉讼外纠纷解决机制,环境行政裁决更能适应现代环境行政管理的需要。而由于该问题横跨环境法与行政法众领域,学术界对环境行政裁决领域关注显著不够,对环境行政裁决的理论研究也不深入。在法制实践中,我国的环境行政裁决制度建设还十分落后,环境行政裁决权力的行使基本处于失范状态。写作本文的目的就在于深化对环境行政裁决制度的理论认识,挖掘行政权解决环境纠纷的潜能,探究行政和司法的融合之道,并在此基础上对如何完善我国的环境行政裁决制度提出个人参考意见。本文主要的研究思路在于立足于中国本土社会,注重理论和实践的结合,并综合运用了分析、比较和实证等研究方法,多角度论证环境行政裁决制度,力求论证更具说服力和时代性。通过研究,论文基本形成了完整的环境行政裁决理论体系,深入分析了环境行政裁决制度产生的思想理论根源,并为完善我国的环境行政裁决制度提出了合理的构想。希望本文对我国的环境行政法制建设,尤其是环境行政裁决制度的法制化进程有所裨益。
[Abstract]:In modern harmonious society, many environmental disputes caused by environmental problems urgently need to establish a set of efficient and sound environmental dispute resolution mechanism. The environmental administrative adjudication is a new mode of solving environmental disputes which is produced by adapting to the development of modern society. Compared with litigation, environmental administrative adjudication has the advantages of simple procedure, low cost and beneficial to solving professional problems. As a mechanism for resolving disputes outside litigation, environmental administrative adjudication can better meet the needs of modern environmental administration. The academic circles pay less attention to the field of environmental administrative adjudication and the theoretical research on environmental administrative adjudication is not deep. In the practice of legal system, the construction of environmental administrative adjudication system in our country is still very backward. The purpose of this paper is to deepen the theoretical understanding of the environmental administrative adjudication system, to tap the potential of the administrative power to resolve environmental disputes, and to explore the integration of administration and judicature. On the basis of this, the author puts forward personal reference opinions on how to perfect the system of environmental administrative adjudication in our country. The main research ideas of this paper are based on China's local society, focusing on the combination of theory and practice, and the comprehensive use of analytical, comparative and empirical research methods, multi-angle demonstration of environmental administrative adjudication system. Through the research, the thesis has basically formed the complete environmental administrative adjudication theory system, has deeply analyzed the thought theory origin of the environmental administrative adjudication system, In order to perfect the environmental administrative adjudication system of our country, the author puts forward a reasonable conception and hopes that this paper will benefit the construction of the environmental administrative legal system in China, especially the legalization process of the environmental administrative adjudication system.
