【摘要】： 能源问题是全人类共同关心的问题。纵观人类社会发展的历史,人类文明的每一次进步都伴随着能源的改进和更替。胡锦涛主席在2006年夏天召开的八国峰会上提出了“互利合作、多元发展、协同保障”的新能源安全战略,这表明,在当前国际油价持续高低振荡的时代背景下,能源安全已经成为我国重大的政治课题,能源安全问题再次引起了人们的关注。当前由道德危机引发的全球经济危机,造成了全球石油价格迅速下滑,缺乏道德节制和法律监督的能源投机环境,迅速消耗着我国大量的外汇储备,能源市场机制的缺失以及能源信息的不对称性,使我国多年积累的国民财富在能源储备交易中一夜蒸发,国民经济受到重创。当今的中国作为一个在经济上迅速崛起的发展中国家,在能源战略面向世界的同时,必须对随之带来的能源安全保障问题进行深入的研究,这是中国一项关系国计民生的重大理论课题,其中能源安全法律体系构建研究,作为国家安全意识形态领域的思想理论指引,是引导中国在现代化道路上避免能源危机的有力举措,是国家法律体系建设的重中之重。能源安全法律是我国新能源战略实施的制度选择和制度安排,是能源安全行为和能源社会关系的调整器,具有很强的规范性和约束力。能源勘探开发、生产建设、经营管理、输送供应、利用消费等各个环节构成了能源安全活动关系,运用法律的手段对能源安全活动关系进行调整和规范就形成了能源安全法律关系,进而构成了能源安全法律体系的基石。本文以分析我国能源态势为切入点,在系统分析能源安全概念、特点及相关因素的基础上,运用比较法对国内外能源安全立法态势作了深入阐述,并在分析我国能源安全立法体系构建必要性的基础上,对我国未来能源安全法律体系从纵向结构和横向结构两个方面进行了全面构建,清晰勾勒出我国能源安全法律体系的应然状态。全文重点讨论了能源安全法律体系横向结构中两种基本立法模式的选择问题,并提出我国的能源安全横向立法应摒弃传统的“能源要素立法模式”,而采用更有优势的“能源活动流程立法模式”,以此为起点,文章最后对我国能源安全横向法律体系的内容进行了举要。
[Abstract]:The issue of energy is of common concern to all mankind. Throughout the history of the development of human society, Every progress in human civilization is accompanied by the improvement and replacement of energy. President Hu Jintao put forward a new energy security strategy of "mutually beneficial cooperation, pluralistic development and coordinated protection" at the G-8 summit held in the summer of 2006. Under the background of the current international oil price continuously fluctuating, energy security has become a major political issue in our country, and the energy security problem has once again aroused the attention of people. At present, the global economic crisis caused by the moral crisis, As a result of the rapid decline in global oil prices and the lack of moral restraint and legal supervision of the energy speculation environment, China is rapidly consuming a large amount of foreign exchange reserves, the lack of energy market mechanisms and the asymmetry of energy information. The national wealth accumulated in China for many years has evaporated overnight in energy reserve transactions, and the national economy has suffered a heavy blow. As a developing country with a rapid economic rise, China is facing the world in its energy strategy at the same time. Must carry on the thorough research to the following energy security safeguard question, this is an important theoretical subject of the national economy and the people's livelihood in China, among them, the energy security legal system construction research, As the ideological and theoretical guidance in the field of national security ideology, it is a powerful measure to guide China to avoid the energy crisis on the road of modernization, and is the most important part of the construction of the national legal system. The law of energy security is the system choice and arrangement for the implementation of new energy strategy in our country, it is the regulator of energy security behavior and energy social relationship, and it has strong normative and binding force, energy exploration and development, production construction, management and management. Transportation and supply, use of consumption and other links constitute the relationship of energy security activities. The use of legal means to regulate and standardize the relationship of energy security activities forms the legal relationship of energy security. Then it constitutes the cornerstone of the legal system of energy security. Based on the analysis of the energy situation in China, the concept, characteristics and related factors of energy security are systematically analyzed. Based on the analysis of the necessity of constructing the legislative system of energy security in China, the legislative situation of energy security at home and abroad is expounded in depth by means of comparative method. The legal system of future energy security in China has been comprehensively constructed from two aspects: vertical structure and horizontal structure. A clear outline of the legal system of energy security in China is given. The selection of two basic legislative models in the horizontal structure of the legal system of energy security is discussed in this paper. It is also pointed out that the horizontal legislation on energy security in China should abandon the traditional "legislative mode of energy elements" and adopt the "legislative model of energy activity flow", which is the starting point. Finally, the content of the horizontal legal system of energy security in China is discussed.
