资源环境监管机制的法经济学研究

【摘要】： 资源环境问题关系到社会的可持续发展,而政府对于市场运行的监管是市场经济不可缺少的环节,政府作为公共利益的代表者,应当加强对资源环境问题的监管。本文从资源环境问题产生的经济学原因出发,侧重于分析环境资源的负外部性问题,并由经济学结论论证如何从机制、体制和制度三个层面进行监管,这个论证过程采用的是法经济学研究范式,并且十分注重论述法律体系的建设在资源环境监管体制中的作用。中国的环境资源监管与发达国家相比,有自己的国情特点,同时也有欠缺,需要学习国际先进经验,改进我国的环境资源监管现状。所以,笔者结合我国资源环境的现状,通过国际比较,得出我国资源环境监管机制的解决途径。
[Abstract]:The problem of resources and environment is related to the sustainable development of the society, and the government's supervision of the market operation is an indispensable link of the market economy, and the government is the representative of the public interest. We should strengthen the supervision of resources and environment problems. This paper focuses on the analysis of negative externalities of environmental resources from the economic reasons of resource and environment problems, and demonstrates how to analyze the mechanism from the conclusion of economics. The system and system are regulated at three levels, and the process of argumentation is based on the paradigm of legal and economic research. China's environmental and environmental supervision has its own national characteristics, but also lacks, so it is necessary to learn from international advanced experience, as compared with the developed countries, China pays much attention to the role of the legal system in the regulatory system of resources and environment. Therefore, the author combines the present situation of our country's resources and environment, through the international comparison, obtains the solution way of our country's resources and environment supervision mechanism.
